Getting stiffed from an ebay seller on a pre order item need advice.

Ok, I pre-ordered the iron man hot toys figure like last sept or oct from a seller on ebay. The person is currently a power seller and isnt responding to any of my email/messages. I have emailed a few times over the past couple of months asking about my order. Any one have advice on what I should do other than not pre order in the future? I paid through paypal so I know they wont be any help now.

I had an issue with something similar, and from what I understood, you could still seek legal recourse through small claims court within a year. However, you need to make your case to the judge, in person, in the town where the seller is located. I hate scumbags who take money and don't live up to their end of an agreement.

Isn't there somehow a way to get your money back through paypal? I thought if you dont' recieve the item, paypal emails the seller, and if they don't respond legitimately, you get your money back.

Sorry I can't help, never had to go through this process myself, but read about it.

It has to be within 45 days of the purchase... by this time, you can't even access the auction anymore since it's been more than 6 months.
 
check the email address you signed up with through ebay.
Sometimes replies don't get back from japanese sellers through the ebay page and will only be in the emails.
It happened to me when I first started buying from Japan.
 
Did you request his info and call him? BTW, did you use a credit card through Paypal? Maybe you can do a chargeback, if its not too late. Any time I order a pre-sale item, if its close to 45 days, I do a PP dispute.
 
That's why I NEVER pre-order anything from Ebay...

:lecture Capital B-I-N-G-O. Preordering > 45 days in advance is a rip off just waiting to happen. At least if you expect something w/in 45 days you can run to Paypal but after 45 days, you are SOL..........
 
they are currently selling on ebay and they use the same ebay name as their web address. They seemed legit and as stated they are a power seller in the US. They just won't reply to any of my messages or emails.

Yup :lecture Make yourself a nuisance and they will most likely respond...sorry to hear about your situation :(

Oh and always be calm and reasonable...you don't want to get reported for abusive contact

Or till they add your email address to their 'spam' filter list and that will be the end of it, from their point of view anyway.

So, as you now know, never pre-order/pre-pay for anything on e-bay.
 
The idea of PO with someone on ebay regardless of their powerseller status or how low the auction was never seem to make any sense to me.

Right now, I'd suggest you to send them a message via ebay on any auctions they may have, that you are making a thread bout their way of business here. And also contact ebay bout what happened. I find their live chat to be most helpful.

I'm going through the exact same thing with a Hong Kong power seller. Sent off four or five emails and finally get a reply that it'll be sent out at the end of April. So another five emails and I get a reply stating it will be shipped this month. Not much I can do but hope it'll happen. I just don't believe this seller has yet to acquire the Ironman Mk3 when it has been out for so long already.

Ebay live help suggested I take it up with the local police and ebay would certainly co-operate in providing further detail. All good except the local police say they can't do anything even if they tried. Live help were able to get me the sellers email address, which I had lost, and give me his phone number. It's really up to the seller to be honest and reputable. In the end all I can really do is report his listing items that don't fall under ebay's policies.

It may be different for you hordeall. You may be able to involve your police department. You'll have your paypal records to prove you have made payment.
 
Jeez... good luck all you guys going through this ^^^^.. Like Creecher says all we can really do is have faith that the items we paid for eventually turn up. I have Ironman mkI and Predator with ABCExpress paid last year and the big one: The Tumbler with Goodshipped paid on June 26th. I've dealt with both these guys before and frankly the only Hong Kong sellers i use...That being said, i'll be glad when these three things are released so i then can (hopefully) expect them shortly thereafter and not worry about it.
I've learnt my lesson now though and will only p.o with Toys2. I'll only use Hong Kong ebay sellers for already released items. At the end of the day thats 500.00 of my money floating around in their coffers with only a verbal agreement they'll deliver the goods and ZERO comeback if they dont. My fault, granted but i sympathise...
