I have a problem with an ebayer, that i won an auction from,
the item came damaged, chips and a crack, no damage to the package itself, no chipped pieces inside the box, and it looked like some paint was used to cover up one chip, the item was descibed as new, never displayed, only opened to make sure it was alright, so i asked for a full refund, he refused, so i filed a dispute with paypal, for item not being as descibed, now he jumped ahead and filed a claim ahead of me saying it;s not true, what are my chances of paypal siding with me the buyer?
 
Just be as specific as possible with paypal. Anytime you have to repsond to their questions, give them as many details as possible. I have had to file two claims and this has worked for me. Did you try to work it out with the seller first before starting the claim? Usually, once the claim process starts, it can get ugly.
 
yes, i tryed to work it out with him first, but he refused to do anything, so i made a dispute request with paypal, then he jumped ahead of me and filed the claim first, saying what i said was not true.
 
I did once and they decided in my favor but the seller disappeared and I never got my money back OR my dvd. :(

I paid for a DVD and I never received it. The seller never answered emails or anything and then his account was gone. I filed with paypal and they refunded my money.

If you paid for the DVD with paypal, then they should pay you back.
 
This is what will happen, Paypal will get you to send the item back (at your own expense with tracking to prove you did it) and once the item is back in the sellers hands (Paypal checks the tracking) they demand the seller to refund you the full amount.

I believe his account (if empty) will remain in the negative until he pays it up so I assume Paypal has some sort of insurance for buyers set in place. You will be o.k. i'm sure of it. This is an assumption of course but I have had a very similar experience.

I paid via Paypal and they did nothing for me... said something about being unable to retrieve the funds from their account :( I still have the thing on my paypal and it's been over 2 years.
 
Exactly what he said. I just went through the process after a month of the initial claim. May sure you watch your Paypal for action that you need to take. Sometimes, email doesn't get to your mailbox. Upload the pictures of the damage good to paypal in the claim. Also MAKE SURE all communications are done through Ebay and Paypal so that they can read them as well. Paypal will give you like 15 days to return the item back to him through an automated paypal system. MAKE SURE you insured it with TRACKING INFORMATION; therefore use FedEx or UPS. Do not use USPS since they have no tracking system. Also, make sure THEY SIGNED for the package. The paypal system will ask you to provide the tracking info and submit to Paypal. At the end, mine had a mistake (computer he said) as it closed the claim in the seller favor when he had his return good plus I was out of the money. I escalated to Paypal; and they reviewed it again on the phone and refunded the money to my credit card immediately.

That exactly what happened to me. I bought something,never received it, filed a claim,won the claim,but the seller had insuffient funds and I NEVER got my money or product. That has been about 2yrs now. $350 lost and I haven't used Paypals services again and never will.

Once I had to send back something overseas and I lost about 50% of what I originally paid for the item in shipping it back. This is why I won't buy internationaly anymore on ebay.

Regardless its way too expensive to even send something overseas. It costs me $47 IF the package is under 3 kg. Not worth it indeed.
