With all that has happend over the past few weeks (the cable good serial killer who kills other serial killers fiasco) i believe that any new sculptor, tailor, etc... who offers his/her works needs to make sure that "alternative" names and titles are used to describe the items you are offering. What do you guys think?

Seems to me like this would be a more effective strategy if it just happened without folks coming out and talking about it happening. . .
 
That was then... I forsee that changing. But again, no official rule is needed to encourage intelligent marketing.
 
Why open a thread about this? Just keep a low profile

It really depends if you are selling a celebrity likeness or clearly trademarked design (e.g. Superman costume). Many things cannot be trademarked no matter how iconic. Otherwise Paramount would sue every hat maker on earth making brown fedoras.

Going after the Dexter outfit was just indiscriminate legal bullying typical of modern corporations. They have absolutely no trademark that they can enforced in that case and stating that Dexter wears a particular outfit comprised solely of generic articles of clothing is a matter of fact.
 
They were after the sculptors/tailors using Dexter images/names in the MARKETING of the goods. Read the letters Xeno and Kato posted. They never asked or implied Kato or Xeno from selling their sculpts or clothing. They simply requested they take the trademarked/copywritten images, names off them as they're not licensed to use them. People are jumping to conclusions.

I think with Trev he decided not to step on any toes so he pulled his sculpt completely due to his 'day job'. (just conjecture)

As you can read in the policies of this forum that have been in place from day one - we do not allow the sale of items that infringe on any license.
