Question on Damaged Statue from eBay

I recently bought the Black Panther PF on eBay. I received the statue today and discovered the his left leg had a small broken piece in it. Upon closer inspection, there is a hairline crack in the leg that will eventually break all the way off. I contacted the seller about the damage. He said to file a claim with UPS as the statue must have been damaged in shipping. Once UPS makes inspects the statue and packaging, he says he will refund my money. My question is what if UPS says the damage is not their fault? What are my options then? Any advice on how to proceed? Thanks!

Just file a claim with Paypal ASAP. Let the seller do all the footwork. It's his responsibility anyway, since the package didn't arrive to you in the condition he sent it. Besides, UPS will require him to do all the work anyway, since he's the sender.
 
Did the seller insure the package? I'm not 100% sure but if it's insured, I don't see how you wouldn't get your money back. I would do all three, ebay, ups, and paypal. One of em should eventually get you your money back.

Yeah it sucks when something arrives broken and most of the time it's the postal systems fault.
But dumping all the responsibility on the seller is pretty bogus.
Why don't you buyers ask for insurance and tracking, which in my case no one ever has. I mean it's an item your buying with your money.
Sold a P1 hot toys figure in mint condition. When it arrived the shoulder cannon was busted.
I know my collection and everything I own gets sold in mint condition.
How do I know he didn't just break it and wants his money back because he's got the buyers remorse.
Not saying you have done that but people are always quick to attack the seller and we are just as much a victim as you buyers are.

When I sell, the buyer doesn't have a choice. Tracking, signature confirmation, and insurance or GTFO. I can't imagine why any other seller wouldn't have the exact same policy when shipping these expensive, fragile items across the country.

I always supply tracking and insurance when shipping. Why would you as a buyer not insure it and put your self out there to get raped by PayPal? Insurance is cheap and so is tracking. Knowing how PayPal is nowadays, it's stupid not to protect yourself. Hell, without tracking you can't even prove you shipped it to the buyer. :cuckoo: :huh
 
In eBay/Paypal's eyes, it is the SELLER'S responsibility to make sure the item arrives to the buyer in the same condition they state in their auction. Sellers need to get that into their heads.

Also, for the OP, the SELLER must submit the claim to UPS, so don't let him tell you that you need to do it.

Try to work with the seller, and get him to open the UPS claim. You may need to take the item to UPS for inspection, but at least you won't have to pay to return the item as you would if you open a Paypal claim, because they don't refund you until you return the damaged item on your dime.
 
Ebay requires the seller to have full insurance on the package. It's not the buyer's fault anymore. Seller's need to make sure they include the price of insurance in the shipping when making the listing.

And it's true that UPS will require the sender to file the claim. They don't deal with the receiver.
