The HT leather jacket is definitely not Film Accurate, it should be brown with Gang Logo. Maybe this is just a proto...
They might not have done that on purpose, again this is a "Brando" figure, not a figure from "The Wild One". So they may just go for close and recognizable (which this is) but different enough to not get in trouble.

I would think the overall look of these figures would be blatant enough if it were a problem but I don't know the ins and outs of those sorts of things.
To me it's obvious what films they're based on though.
Well its kind of like giving Ripley red hair or Drake a Moustache. The underlying sculpts and work is there... but they are able to get around the likeness issues. Now they are just doing it in the opposite direction.
He's obviously Brando from the Wild One, but its not until you look (maybe) at the back and at other details that you realize he's not all that accurate.
I wonder if they could expand this out and give us some Kubrick movies... maybe they could get the rights to a McDowell figure.
