Yes, he will be in it, but you can make him a free agent or trade him out if you want.

Just glad I got the Giants for the tourney!! To bad I suck at Madden though.

Yeah, I absolutely hated that. The only Madden game for 360 that I don't have 1000 gamerscore for. It was too time consuming.
