Oh man...same thing happened to my Hot Toys Ed-209, his foot was cracked clean off, it looked like someone used the box it was delivered in as a stepping block.

Oh that sucks - big time!! I really feel for you. I know how excited I am when the package arrives - tearing it open like a kid on Christmas...and then to have it broken - I would be crushed!!!!

Wow! Talk about an incredible seller. Sent the pics and he refunded all of my money. Even shipping!
I feel bad for him though. One large chip from the piece is not in the box, and it sounds like he may not have inspected when he bought it on the secondary market. It may have been broken before he even shipped it.

I'm curious about something. Since I don't do too many deals on ebay I was wondering if you received a broken item, does the seller or the buyer get to keep the broken item and who has to handle the insureance claim?

On a claim, it is the responsibiity of the buyer. The shipping service keeps the piece and will often sell it to you at a fraction of it's original cost.
