Well, I guess we'll find out. It does say "his item number" so I don't see how it can be that of the dio. Whether he is portrayed as living or dying is not relevant, since they're just using that description as a way to identify who they are talking about, not to distinguish between the two items. At least that's my take on it.

Yes, but he's not alone in the dio. Likely it would also have mentioned the Dark Lord.
