I think the cape just isn't posed properly in any of the pics. It's a little too long also and drags.

Well there's nothing you can do about the material other then replace the whole cape outright, which I'm thinking would not be too difficult. I do think the cape will be poseable, no way will they ship it on a rigid pre-posed frame. So repositioning it will be possible. Length, you could fix by cuting it short around the neck area. I think it's possible that the cape would come separately from the figure, so there might be some options.

I'm sure the cape will be wired so we can pose it anyway we want, that's what they did with Superman. It just looks a bit sloppy in all the poses they've shown.
