No, you can't start a claim with PP if the payment was made as a gift

The only possibility (I think) would be if the payment was backed up by a CC, it may be worth checking with them about claiming a chargeback.
If it was a gift payment though, Paypal will not really help much (as far as I know).

I've been following NoN's saga and I'm sorry this has happened. There is no excuse for why Merc shouldn't be responding to Non's requests for an update, especially if he is still active on these boards. Hope this gets resolved amicably, but lesson learned for everyone: Don't use the Paypal gift option unless you are really really sure about the seller and even then back it up with a credit card.

May I just say this though. Please, PLEASE IF paying someone by Paypal, only use the gift option if you know and trust the person you are sending the money to. Even in that instance back it up through a credit card if you can.

Please cover yourselves as much as you can when buying from anyone, be it here, eBay or anywhere else.
