I won a Iron Man Comiquette - Sideshow Exclusive recently. The seller had good feedback nothing to say that he was untrustworthy. I sent payment the same day I won the statue as I was excitied about getting one and wanted it fast. The seller beats around the bush about when he shipped it ...etc. Then I get an email 2 days ago saying he was out of town and the postoffice is picking up the item from his mom. Now I am like Oh Sh*t, I am getting screwed. So I asked for an update today and I get...The post office called me and said that the statue box fell and I asked them to open it and they said the finger broke......Now I fell my temperature rising as I am getting pissed...what post office calls the person sending a box...I shipped alot of boxes and I am SURE the post office dropped, threw, sneezed, and tossed almost every box I sen...also they would NEVER open the box up....I told him basically to shove the statue up his A$$ and refund me my money as fast as I paid him. This ***** better pay me back within the next 2 days...sorry guys had to vent...off to search for another esclusive....I want to hang this f'in guy :mad:
 
Sounds like you getting taken for a ride. Especially the USPS opening the box.

sounds like you gave this guy a loan....hopefully it's just a loan. that sucks.
 
If this goes bad I will definiltley disclose this A holes name so all of you dont ever have to deal with this.....he has 2 days before I loose it
 
I did use PayPal but I have to wait a few before filing a claim....anyone trustworthy have an ironman exclusive for sale?
 
Good luck to you. When you get the refund you may be better off waiting until the new SS Stealth version hits the market, I'm guessing that will decrease the value of the current ones by some amount. Just a thought.

Actually, Paypal loves money. There's no telling who they'll favor, although in your case, I'd say you have a really good case. Worst case, issue a chargeback. I think the seller will refund you though. Honestly, he probably changed his mind about selling and came up with a bad excuse.
 
Did you also pay for insurance on the figure?The Post Office should cover the price of it if they did indeed drop it themselves.

How can they get all the Hulk and Cap PFs around in one piece and not handle a simple Iron Man Comiquette?Sheesh.
 
Does sound like you have a very good case. Did he notify you that the post office rang, and he asked them to open it up, through an email? Even better if he did. Keep it safe. I would email him asking him to tell the post office to return it to sender, and return your funds. I'd jump through the ebay and Paypal hoops as quick as I could, and if the parcel shows up, don't sign for it. Let them send it back.

If you have the email, you already have him on 'not advertising as described', bare minimum. I would let him know that. If he is the real deal he will comply and send you your money pronto. Let him deal with the post office and insurance, or at least their liability for having admitted their clumsiness. You don't want a broken item and he will appreciate that. No reason, therefore, to hold up your funds, as you want to search for another mint item.

will reveal after I see how he handles himself....if he is professional about the situation....no need to drag him threw the mud...but if he doesnt do the right thing...all of you will know , paypal will know...ebay will know....credit card company will know

Hey mate,

Sorry to hear about your bad experience. What I would do is that I would make my claim with paypal, they send a message to the buyer then if he doesn't refund you, you can escalate your claim and hopefully get your money back. I was getting mucked about on ebay by a supposed shop, I bought LOTR trading cards and they never came, I kept getting empty promises thus I filed a claim with paypal, then they sent a message saying that it may have got lost in the post and they will send a new set. Then I saw that they were no longer a registered user and instantly escalated my claim and got my money back.
