Lawsuit on what? Non-binding, non-approved sales of unlicensed products? How would one block someone's bank accounts or seize someone's assets? Hire a bounty hunter or a hitman?

Only thing we could do is probably try to find this dude but once you trespass your good as dead with this justice system.
Would it not be fraud? It's very much similar to a ponzi scheme.

not sure why clothing needs to be licensed, is that a thing? But I'd hold back on filing a claim/lawsuit until some local freaks can give him a visit.

This is a binding legal agreement. There is a contractual agreement between Moe and whomever he received money from and I'm sure it is written in PM's or personal e-mails. He offered a product for a certain price, you accepted, and payment was sent. Small claims or a class action suit is the best alternative to being reimbursed. A judgement will be issued against him and you can have his assets//wages garnished. You can have the Constable handle this for you.

At a minimum, if someone owes you money, you have to first make a formal demand. This is best done in a letter which gives the other person a deadline by which they have to respond that is at least ten days from the date they received it. Send the letter certified mail, return receipt requested, and save the return receipt if it ever comes back.

If the deadline comes and goes with no response, your next step is to file a lawsuit. Again, the amount in dispute can dictate the court in which the suit is filed. In small claims, you can represent yourself.

Once you file the lawsuit and serve it on the party that owes you money, they have 20 days to respond or you can seek a default judgment against them. If they respond by filing something called an “answer,” then you’re in litigation. Whether he shows up or not, the case will still go through. He will also be responsible for all of the court costs.

Each person should send him a certified letter and put the pressure on him. His excuses of health issues will not hold up in court.

The clothing doesn't need to be licensed. There is nothing proprietary about it.

Greatlakes6 said better than me... I don't know how the legal system works in the US, but in Brazil it's quite similar to what he said. In here, when we get a final decision granting our right, and it's not possible to discuss it again, we go to the stage called "execution", which means, taking acts to ensure the decision will be fulfilled if not paid voluntarily. Then enters the bank account blocks, arresting assets, etc.. if he has anything registered in his name.

Sorry to hear about this. But sadly, I'm not shocked. Guy never seemed totally on the level in my interactions, to the point where his involvement automatically removed me from being interested in a project. I hope you guys can get this resolved, but past issues of this kind never got much traction in terms of a legal solution.

i felt you had him on the ropes when you seen that ebay dude for sale with recast head.. all he wanted was for it to go away remember....came up with a story...you i think caught him that day... but nobody listened...

A little late to this thread but I am also waiting on a Chem Suit I ordered and paid $135 in full for last October. Moe has been pretty good about responding to my messages (emails when his inbox was full) but it has always been about his medical complications and that orders are coming in slowly one at a time (which doesn't make sense), never definitive information about my specific order or it's progress, just always "soon" or "eventually". I am hoping that it really is a big misunderstanding and everything can get sorted in the form of clothing or a refund. I am past the point where Paypal could do anything to help the situation and just have to rely on Moe.

I know the tailor and I know moe puts quite a big amount on top of the cost for himself adding a few buttons the guy is a scum bag simple as, and the health issue thing ok that maybe true but why say he has put orders in and there nearly done ect its lies upon lies we have been screwed big time

I had Bad dealing with moe right from the begging. Back around the time of my soprano set. Should have came out and told everyone who was a No good but i kept it to myself instead of making drama. I should have just spoken up!

Some real sad stories in here. I feel for those that have lost a great amount due to this scumbag.
For me it is the Amsterdam outfit $270, still hurts but that is little compared to what others have lost.

I always knew Moe was just a middle man that was gouging everyone so I passed on every project he was involved in because I was worried about his tailor eventually bailing. I never suspected that he was following the Sovereign Studios ponzi scheme model so I thought I'd take the risk with the D&D set. If I would have known that he wasn't giving the money directly to the tailor I would have never paid for the blue d&d tux. I went against my better judgement as I really wanted this set. I guess my toy addiction got the best of me.

It's terrible that people lost money, but it's almost comical how these "so and so member ran off with our money" threads are IDENTICAL:
- the healthy and happy artist clearly has a ponzi scheme going for a long period of time and plenty of vocal supporters.
- when he gets backed up to the point of no return he suddenly has a "life circumstance" (sick, divorce, etc)
- supporters come to his rescue ("he's an honest guy because I got MY stuff") and admonish any freak that wants what they paid for, usually with the ultimate argument winner: "they're just toys" (ignoring the fact that you paid "just money" for them)
- months go by and those defenders lose steam and the people who want their money start talking about pressing charges or "paying him a visit" especially when they think about all the expensive toys this guy has used their funds to buy over time and all the money that he's holding onto. Enter possible "lawyer" freak who bashes the idea ("you're buying non licensed items so you have no case"). Long argument ensues. Infractions are given.
- Behind the scenes the artist continues to take money from unsuspecting victims who just missed the thread somehow.
- Fearing possible legal action, magically the artist returns and makes promises or goes into full defensive mode (or both).
- The artist's supposed "wife" or "brother" or "business manager" (basically the artist's alter ego) comes in to either "save the day" or insult the hell out of all the people he ripped off. Usually uses the "they're just toys" argument. Also typically uses the we're "grown men playing with dolls" insult as well. This is the most hilarious part of the cycle.
- noob necroposts in artist's thread: "can I still buy this?", probably pays up too.
- In the end the artist either walks completely (he probably reads the thread and sees the "you can't press charges" post and feels relieved), gets banned (which essentially lets him walk) or delivers items to the most vocal and screws the people on the bottom of the ponzi scheme.

This has happened over a dozen times and it will happen again. I'm stupid for giving my money to people without the product being completed but it still sucks anyway.

I believe the only reason i received my orange Tux was because Moe kept asking me when i was sending payment for Blue Tux? I told him i would not send payment until Orange Tux arrived. A few weeks later Orange Tux shows up and i sent payment for Blue Tux thinking everything was alright. Boy was i wrong!

He did the same thing to me. He delivered the orange tux and started pressuring me for the blue tux. He made it seem like the blue tux was going out pretty soon afterwards, I fell for it too.

Yeah, a lot of this seems very intentional. Again, it's still possible this is all a huge misunderstanding, but at this point I'd be suprised.

And tbay, your history is pretty spot on. I don't know if legal action can be successfully taken in a case like this, it's certainly been talked about in ever case (Les, Darkartist81, Chris Howes, etc.) but as far as I know nothing ever happened.

There does not seem to be much protection when you get involved in custom projects that require money up front and will take longer than 45 days. Not to mention I imagine a number of these purchases were sent as "gifts" which would seem to mean you would loose any chance of getting back your money, even if their was an eventual lawsuit.

Same with me to guy's! I had to keep bugging him to get my orange tux, it finally arrived so I figured all was good and then he started to pm me several times wanting payment for the Blue Tux which I went ahead and paid. He said they were being worked on and almost done.

Man I feel stupid.

As an artist who does custom work on this forum this kind situation will most likely hurt me and many other artist who are legit with future projects. I don't understand it, when you/I as an artist ask people for payment it's because that money will be used to pay for having the product you guy's paid for made. That's all it should be for, if the product is not ready to be made then don't ask for payment until you know it's at a point of reasonable turn around, not 5 months to a year. It's amazing to me that people actually have the balls to burn people. I could never ever think of doing that to anyone.

After 45 days, Paypal will not protect you, but the legal system will. If your Paypal payment is attached to a credit card, then you have three months to recover the funds, your credit card company will cover you.

The reason nothing ever happens in response to these type cases, is because most people never follow through. There is a lot of talk at the onset, but then they either don't know how to handle the legal aspect, they feel like a couple hundred is not worth the effort, etc. People continue to take advantage of others because they are allowed to. If he is not held responsible, legally or otherwise, then he will continue to do this to other people in other places.

By listening to these comments about dealings with Moe, going back well over a year, he was clearly telling everybody what type of person he is. A few listened and when the red flag went up, they walked away.

Even if a portion of what he owes everybody is recovered, it can be split amongst those who were taken. Something is better than nothing.
