Truthfully the seller is responsible here as they need to make sure the item is covered until the time it arrives to you. Paypal is pretty clear about this, if the seller didn't insure the item they will almost always side against them, its in the protection policy. Sucks for the seller, but he should have know better.

The only caveate I would add is that if you actually requested to not have insurance (to save money) then I'd say its your fault, even though the seller should have disregarded the request. But doesn't sound like this is the case here.

There is something like that for international shipping though... I can't remember now...

Priority international automatically has like $76 worth of coverage... that's the only one I can think of with an automatic insurance w/o buying extra services.

Sorry to hear about the news, Mesa. At first, I understood your point about not "screwing" over the seller because it was USPS's fault from the sound of it. BUT, then again, as a seller myself, it's ignorant NOT to insure all items. And you almost have to wonder what the seller was thinking, especially with the kind of response he/she gave you. I would want someone to be a little more helpful than that. Add that to the post that mfoga made about Ebay's rules making it the seller's responsibility to insure all packages, and I think I would ask the seller to politely give you some options/help. I would hope he/she would, because ultimately, he/she is liable for this one. I can't see USPS taking the blame, especially without insurance on the piece. If they do, I'll be REALLY surprised. With that said, I have a feeling you're going to need to take this one to Paypal. The seller doesn't have a "leg to stand on."

the same thing happened to me l got avout 10 poster from the states and the tube that had my godfather one in it bend so the poster had big rinkles down the center of it.the guy gave me a rude stupid response so l gave him negative feedback and got negative feedback in return, go figure, that was about 2 years ago.

I've had postmen deliver damaged boxes and he'd wait until I opened them to see if everything is alright. I guess alot of it depends on who your postman is. UPS the same way.

I've been hit or miss. For about the past two months or so, I think I got a new UPS driver because the service has done a 180. If I'm not home, they'll leave it with my neighbor (after I asked him to) or they'll even try to redeliver that same day. The last guy would do any of that.

Sorry Mesa. I disagree with most of the posters here. If the Insurance was provided as an option and you chose not to select it, than I cannot see that being the sellers fault. Whether it is a good practice to always have things insured as a seller is another argument, but as it stands, it seems to me that you were aware before hand that you were ordering an item without insurance. For the record though, the sellers response was not very considerate. Goodluck with whatever you choose to do.

I think I'd walk into the post office with those bent tubes and ask them to explain how that happened.

I don't think the seller has a responsibility here, looks like insurance isn't required although it was offered, if you didn't pay for it then they shouldn't be penalized for it since it was offered. Your only option would be to take it up with USPS, which I doubt they'll do anything about.

And it's the same issue with online retail, they might make you a deal if something goes wrong, but they still take things up with the shipper themselves instead of making you do it.

Are you contradicting yourself? If it's the same as online retail, why would Mesa take it up with USPS and not the seller?

Really I did an online claim when they broke a case I shipped. I had him take pics of the case in the box and of the box and the case, aattched those to the claim. The guy had a check in just under 2 weeks.

I'll have to verify this through SNOPES.:lol

Without there being a box for buyers to check saying "I decline insurance and accept responsibility" it is a seller issue. Mesa can just file a PP claim for "items not as described" and win the claim.
