another ebay question

ok, i had some grid aliens for sale, and someone offered to purchase all 4 that i had left. so we agreed on the price and shipping costs and they were shipped.

so here's what happened, he received said aliens except he's claiming that i sold him warrior aliens since i goofed and had two out of the three pics wrong :banghead sht.

but my listing, description and one pic clearly state that this is grid aliens that he is purchasing.
so i'm wondering what you long time ebay users can say about this, and what ebay/paypal will descide in this situation.

i have already offered a full refund of his purchase price, just he has to ship them back to me prepaid.

unfortunately, i'm thinking that yes i did have a couple of wrong pics and i'm not disputing that fact. but sht man is this guy a ^^^^ing idiot and can't read the listing or discription:confused:


EDIT: just went back through the correspondence between the purchaser and I, and the phrase Grid Alien is mentioned no less than 12 times in both the message headings and the actual messages sent to him.

I see 1 wrong pic in there but everything else clearly describes a GRID Alien figure.

So that's on dude if he can't read and is easily confused but a single picture amongst everything else that clearly states it's a Grid Alien figure. F' him.

well this is his email that he sent me. at this time he really isn't asking for anything in particular, just asking what i'm going to do about it.

i recived the item and there is a big problem
i saw the picture for alien warrior special version and u sent me grid alien
i already have 6 pieces of these and i will not want to accept this as u did not describe this auction with the correct picturespls tell me what u are going to do

personally i'd like to tell him to ^^^^ himself, but i guess in a way i do see his point that i had the wrong pics posted. but other than that i think he's actually doing this on purpose. i mean if anyone with an ounce of brains could see that this is grid alien, and if i saw this discription with them pics, i'd firstly assume it was and if i saw the alien warrior pics then i would of asked for sure firstly before purchasing them. so i'm really wondering if anyone out there would know were i'd stand in ebay's eyes and what my legal obligation is to him.
 
Your auction title and description only mention Grid alien, so he's grasping at straws. Do not, I repeat, do not refund his money and expect him to ship them back to you. I wouldn't trust him. What's his feedback rating?
 
You both made errors here. He didn't read the description or question it before purchasing, you posted the wrong pic. I would offer a refund minus any shipping costs, returned at his expense. Then neither of you are out the full amount. If this was the solution offered to me, I would take it and leave positive feedback. Good luck. ( I would only give the refund once you have the figure in had returned by the way)

he's like 99.4% positive with over 1700 rating, and the 2 negatives he has could very easily be contributed to shipping problems.
really seems odd, since if he did a search for alien or hot toys alien, the first word in the listing and the whole description relates to grid alien.

as for any sort of refund offered, i actually just saved my response to him in my drafts until i got some more feedback from you fellow freaks.
if i were to offer him any sort of refund to him minus shipping cost, would that mean the shipping costs to him also, or just the shipping costs incured back to me? cause of course he wanted these shipped to him via airmail to japan which cost about $250. if that's so then i really think this guy did this on purpose then.:(

People never read the description. I get so many stupid questions it's ridiculous.
 
well this is what i sent back to him, to see what he has in mind and if he gets really stupid then i'll just have him send the aliens back, cause i'm sure no one is this stupid and/or illiterate that they didn't know that they were buying grid aliens.

well i'm just a little confused on this one, yes it does appear that i may of used a couple of secondary pictures in error, but the main listing as well as the complete description boldly states no less than 5 times that these were Grid aliens. as well as the first and primary picture.
so i guess i must ask you, what would you like to see happen here, then at that point we can descide wether or not if we have to go through the ebay dispute process.

a small refund of $200 for items that he only paid $450 for give me a break, i'll take them back and burn them before i cave into this ^^^^^^^.

nope, i guess we'll have to go through ebay dispute then, and if i have to i will take these back, since i'm thinking you mostly planned this from the very beginning, and there is no way that anyone that can read and type english such as you have demonstated with your emails, could of possibly thought you were going to not recieve grid aliens.

so unless your willing to make a more reasonable offer then please contact ebay in regards to this.

Have him ship them back, take your negative that he will leave and then tell him to fauk off.
 
Yeah, if he wants to be a hardass about it you will probably end up just getting them back as eBay will probably side with him because of the listing error. But a refund of $200 is just ludicrous, personally I wouln't refund him any amount unless it was around what it would cost for shipping all 4 figures.

yeah the shipping originally cost $225 i believe, but that was because he wanted them shipped by airmail, if i recall the regular shipping would've only cost $75 to $100. so that's what i was thinking i'd MAYBE agree to.
but for $200 he can go :banghead himself.

i'm thinking that he'll comeback in that area, cause he obviously wants these since he knew what he was buying, even though he states that he wasn't expecting grids but warriors.:lol:lol give me a break.
 
if paid via paypal, wouldn't hurt to call paypal and inquire before they almost 'automatically' side with the buyer.

and keep your evidence handy to provide to eBay and paypal for shipping costs, etc.

what return policy did you list in your listing? (I can't see ebay from work)
you should stick to that. if it states buyer to cover any return shipping, then he pays.
 
if he saw pictures of grid aliens and warrior ones, he should have asked because the description says grid aliens. his fault.....basic buyer knowledge imo. hes just not very intelligent.
 
Paypal doesn't give a squat about any return policy that was stated in the auction. If you can't prove you shipped, buyer wins. If buyer says item is not as described, paypal requires the buyer to send the item back and provide proof they sent the item as well. Seller will be out the shipping and the buyer will be out the return shipping.
 
Based on all the items in the guy's eBay store, he's not a n00b when it comes to figures. He knew what he was purchasing. Your auction title and description only mentioned the Grid alien.
 
ehhh this is a tuff one but i would go with the pics as reference frist. I think the problem was picture of the actual product on your behalf over all i would just get him to ship everyback to you. Before paypal F's you over.
