The seller won't do anything besides claim insurance first, no partial refund or any other way to solve the problem. It told him all above you said and he still telling me to do so, I was pissed and tell him forget it and I will not leave any good feedback to him, he been selling many statues now, I don't know if this will happen again.
File a PayPal claim. Ultimately, if it is damaged in shipping, it is the seller's responsibility to file the claim. You are also NOT required by eBay or PayPal rules to sit around waiting while the seller files the insurance claim with the shipping company.
I would not let him/her bully you into anything. I would do what will get you results, as you are the one who would potentially be out a lot of money.
