Yeah, I think ebay suspends or closes peoples accounts if you don't file through ebay/paypal first. Then if you don't get satisfaction, hit your credit provider.

You know what is funny, I once filed chargebacks on thousands of dollars worth of stuff with my credit card company and didn't go through Paypal first. All that happened to me was my credit card company contacted Paypal and Paypal opened disputes. I got my money back(from my credit card company, not Paypal.) and my account was fine. I still wouldn't chance it, but I guess I got really lucky.
 
I can see what you are talking about...the paint app is different on one eye compared to the other...did this show on his auction in the pics or did he just show retailer pics? ...again this is just me...why go through more hassles when its an easy fix?

Hey DD, thanks for the advice. but unfortunately for me it is not an easy fix since i have no skills with a paint brush and would probably make it worse. Who's to say that I can get the shade of white paint to match the other eye too?

I paid almost $250 shipped for this and ive seen many go for way less. This is the main reason why I am not settling for this defect. If I had got this for a steal I just may try my hand at fixing it myself.
 
Nash, this is the way I see it, you've gone as far as contacting him and asking for a resolution in an appropriate way. He's clearly false advertised it and has declined you a resolution. Simply file the claim, you're right he does want to play hardball, so play back.

Paypal first then Ebay shortly after, he will respond but in this case Paypal will side with you, I promise. The thing that may sucks though is Paypal may have you ship it back to him (you pay to ship) and recieve a full refund.

thanks for the sound advice bro. I filed a dispute and the seller chose to escalate it to a full out claim. He wants to refund me $204 minus all of his fees which total about $40. I declined and opted for the claim to decide who wins.


This is something I worry about any time I sell a collectible. I'm really not as picky as some people, so "near-mint" to me might just be "good" to you. Because of this, I always point out every imperfection no matter how insignificant I may find it to be when I sell. It's up to the buyer to decide if it's acceptable to them or not.

Then, after the auction is complete, I examine the item one more time before I box it to make double-sure I didn't miss anything the first time. If I did miss something, I give the buyer a chance to back out before it ships.

I may lose a few bucks by listing all the imperfections, and all this might seem like a hassle to some but I look at it like this: What's the bigger hassle? I'd rather do that than face the potential of bad feedback, ebay fees, and the loss of shipping costs X2... not to mention the e-mail drama.

I know what you mean. I sometimes get a little worried about listing something with small imperfections too.

The seller does have a point, that this is a hand painted statue and will not be 100% perfectly painted. However, MY point is that the defect is in a significant area of the statue, the FACE! The seller said that I could nitpick this statue to death that the black webbing lines are not all perfectly painted blah blah blah. But IMO that is trying to avoid the issue at hand, which is....when you look at spiderman's face, it looks like crap because of the smudging in the white paint. Sure his webbing lines are not perfectly painted but I can live with that and that is not my complaint on the piece.

I think people tend to be okay with small imperfections as long as it is not on a significant area of a piece.

The seller did not post a pic of the staue just the box.

...I see...250 is alot of money and I can see why you would want a mint statue. It would be difficult to match the paint of the other eye...which means you would prolly have to paint both eyes. I've done alot of touch up work myself, and its amazing what you can get away with a good paint pen. :D
 
was it advertised as displayed or new in bow? this guy could have maybe never even seen the piece...but you are doing the right thing...it takes a few to go thru the right channels but in the end it will favor you....if it does go all the way to a claim and the buyer still is impossible....as long as you send paypal the tracking info that you returned it...they will auto credit you the entire amount you sent him.....but that involves you paying the return shipping...
 
Ahhh the trouble of the collecting hobby. Like somebody mentioned before, I also mention as many imperfections as I can even if the item is 'mint'.

Did he post photos on his original eBay auction? If he did it might've been hard to see the smudged eye or he purposely took it at an angle to avoid it. Sure the webbing can be a little messy, but I completely agree with you that the paint smudging on the eye is too much.

Good luck with your dispute, hopefully Paypal won't rule against you.
