Help!! Purchased a sealed Iron Man Mark 42 on Ebay, File Claim or Just Accept it?

Wow. That escalated. There are some aggressive and offensive posts in this thread.

It's so hard to keep a healthy and respectful debate nowadays.

I think when you buy something as new and unopened from a individual (not a store) you are acknowledging that any damage is outside of the seller control. If you proceed it's because you are willing to accept that risk and should not expect refunds or replacements.
 
That is a very minor scratch in my opinion. I had to study the image for a few seconds to see it in the armor, as it didn't immediately jump out at me. If everything else on the figure is perfectly fine, then I'd keep it.

As others have mentioned, if the item was MISB, then it was sold to you as advertised. I wouldn't make a big deal over something that minor.

just insist on a refund, seller has to give you full refund including postage and seller have to either bear the return shipping (make sure you select DHL/Fedex/UPS), or provide you a full refund and you can keep the item.

it is totally up to you as a buyer to dictate the outcome.

also you can always put few pieces of potato in the box instead of the ironman you just need to make sure the weigh tallies with the ironman.

What's your eBay handle again?
 
I agree that the seller should keep the item and move on...devil's advocate...This is an easy enough ethical dilemma though...would everyone feel the same way if the MISB figure had SIGNIFICANT damage...? I imagine most will reply to the thread "yes" but I can imagine that many would not even let the figure hit the floor before they started typing their refund requests...

Thanks for your input. I've been collecting now for two weeks. I've bought 5 figures from sideshow 2 from amazon and 2 from BBTS. All were NIB. This was my first ebay experience. I'm fairly certain that its a manufacturing error. Because im new here I was mainly wanting to see if the damage would be considered minor or not. Personally i'm fine with it but i've seen people freak over very small details and i wasn't sure if other collectors would be fine with the condition of the figure or not.

You could probably find a parted out one and fix it
 
Mostly good advice, I hate buying any Iron Man products, because its a dice roll, even buying straight from SSC. I literally click "buy" and start praying.
 
I would keep it. Iron Man is just one of those that you roll the dice on no matter where you get it from. It could've been worse :lol
And the potato guy.. :slap Reason why I no longer sell on ebay.
 
This guy is a joke, look at his past posts. Half of them are about eBay.
Potato only good for cutting up, mashing, boiling or frying.

I'm just amazed this forum tolerates members telling other members how to commit fraud. Amazes me really.

There are lots of overly critical collectors. Try not to pattern your sensibilities after them. Lol

MK 42 was known for QC issues when released, including the arm falling off. If it was MISB the seller has no knowledge of any factory flaws maybe buy an opened one next time so you can get a more detailed description of the item. I also don't sell on ebay anymore because of the buyer remorse crap that ebay always sides with.
