Doesn't sound good to me at all. Did you pay an MIB price? If I were you, I'd seek a full refund. You had no idea from their description that it'd arrive in the condition it did.

They knew full well what they were sending and you didn't. I think, under 'item not as described' that you would have a case.

It might then be a while before you got another figure, but, you could get one knowing that it was 100% what you wanted.

At the end of the day though, it's up to you what to do....
 
Yeah, it sounds like you should return it. Mine was brand new, bought from Toys2 about a month ago. The mirror on mine has a small scuff or two and the snap on the pants bends, common issues with this. But the clothes and paint are perfectly fine and you should not expect anything less.
 
Seller for that item was me, by the way. I tried to do my due diligence, and wasn't trying to screw the buyer. I never said it was mint/brand new. Others are saying these are common issues, which makes sense to me considering I kept it in the condition I received it in, etc. Having said that, I'm working it out with the buyer.
 
It was opened and was displayed but they had great 100% feedback so I bought it solely on that. But didn't give a clear description. The pictures were taken in such a way that the problems were hidden.

The item was described as 'used', therefore it's up to you to ask the questions of the buyer regarding the precise condition of the item. People have different expectations as to what they consider acceptable in a 'used' item. You can't expect that the feedback rating of a buyer provides any guarantee that the item will meet your expectations. It's great that Karamazov is communicating with you about the transaction, but I can't say I'd do the same. You bought it based on the description provided, fair and square. Honestly, how hard is it to ask a question of the buyer before you buy it? The least I'd have done before handing over hundreds of dollars would be to request a list from the seller describing where each component might not be considered mint. Then you wouldn't be in this position, and neither would the seller.
 
Well like Lejuan says, some buyers will have more expectations than others, and there's really only so much a seller can do in that regard considering this inherent subjectivity. It seems that you were looking for a mint/new figure. If that is the case, had you asked me about it, I would have told you not to bid at all, because I can't step into your shoes and imagine what that means to you. Regardless of how well I tried to go over things, I can't necessarily anticipate that a slightly warped wall of the base, or a scuff on the mirror/box, or something along that line would matter to you enough that you would not be satisfied and demand a refund. Particularly when most (if not all) of those issues were likely there when the figure was first opened. For instance, I once sold an item and all I said was that it was in "good" condition. Someone bought, and immediately messaged me saying that they expected it to be "perfect" because I said it was "good."

To my eyes, the figures were fine (if I saw something that I thought was noteworthy, I would have mentioned it), and based on my experience buying and selling (over 800 feedback on eBay--all positive; over 50 here on the old and new systems--all positive; probably 200 elsewhere on the web--all positive), I think I have a pretty good idea of what most collectors would reasonably expect from a well kept up used figure. I might humbly reiterate Lejuan's suggestion that if your expectations are so high with figures bought on the secondary market, you at least ask the seller first if they have a pristine item when the auction listing does not say as much. While I understand that buyers don't like to be hassled with this stuff, it is tough on a seller, as well. You have a right to buy what you want to buy, but not everyone will have the same standards and expectations that you do. I'm now out $100 from the purchase price of this figure (including fees). That's much less than I originally paid for the figure.

I have read both sides, I would take the 'strike' over losing $100+ but that's just me.
 
Pretty crazy not to ask details of the seller when shelling out hundreds of dollars for an item that is clearly described as 'used' :dunno

Because with a few hours left of a auction, I honestly didn't expect him to get back to me before it ended.

Listing items without a description entirely still is wrong as well.

If he lists an item without a description, it is up to you to ask for details unless he states mint, new in box, etc. The guy has great feedback for a reason. Refunds can be negotiated.... With $100+ refunded, I suggest you have a coke and stop rising to the disgruntlement of other forum members. You managed to get a steal on a DX04 over what many would consider minor details.

I never said 100+ get your facts straight. If Kara wants to state what he gave me back he can. It's none of your business.

You should have just asked for the DX04 back and returned the money. You could easily sell it to someone else in that condition and let him try to buy a perfect DX04 for the price he wants. :mad:

Can you tell us where you got that suit? I see all the ones offered on eBay and have no idea who to buy from and what the quality is like.

The yellow jumpsuit and shoes are from the Enterbay Game of Death set.

After getting outbid many times on ebay, I finally scored a suit for about twenty bucks and the Asics for eleven. They still get parted out for decent prices if one can be patient. Your best bet is an established Hong Kong seller with good feedback.

The complete Enterbay GoD set was ridiculously overpriced with a degrading muscle torso, but the quality of the Enterbay suit & shoes is far superior to the "custom" knock-offs out there. The yellow is a nice orangey mustard and the shoes are actual fabric with real laces, as opposed to a painted rubber cast.

The head and body are the DX04, of course.

I don't see what mod status has to do with anything. Snake posted about a deal with me, as a collector/seller, not as a mod, and I responded explaining my position. Mod status played no role whatsoever in that interaction.

And if you think my behavior as a mod is self-serving or somehow inappropriate, then I would encourage you to share your thoughts. I'm open to complete transparency in that department.

I still can't believe this is still being discussed...

I brought my purchase to the thread and didn't know I got it from Kara. The matter has been resolved, end of discussion on it.

And what's wrong with Oklahoma??? :mad: Man up and state your city/town. I choose to live in Oklahoma because it's a damn great place to live. I get to enjoy badass steaks, root for the Thunder, cheer for my Sooners, blast my guns, and I don't have to deal with awful winters. What do you got? Prick. :thwak
