He's gonna do what he's gonna do. I just think he would have been better off saying nothing...IMO.

yeah, I could do it, but two reasons why I didn't want to keep it:
1) I feel bad when keeping my mouth shut :) (moral etc...)
2) for future deals with this buyer, it wouldn't help if he knew I kept an item I didn't pay for and didn't tell him

on the other hand, there are sellers enough of cours, and also what could he do to force me to pay. I live here he lives in Hong Kong...

but still, It doesn feel right if I would keep my mouth shut knowing I have no legal grond to stand on.
 
When considering moral and ethical decisions I think the best course of action is to take a moment and think about what you would want done to you. Would you want somebody to profit off of your honest mistake? It seems wrong to take advantage of this seller. It isn't that we are all righteous, it's that we believe in being good to each other and trying to do the right thing.

The fact that you seem to think it's OK to openly and willingly harm another person whether it be just for profit, speaks volumes about your character. You even seek to justify your thievery with "ps: the guy isn't gonna get poor because of one figure"



Don't EVER bother responding to my For Sale threads because you are now an officially BLOCKED buyer. :)

If this was me, I would have immediately contacted the seller (I would not have done legal research first to see if I could somehow keep the figure) and asked him to send $$ so I could ship the product back to him. If he then says don't bother (which I highly doubt he would since it's a Takura batman) but if by chance he did, then bonus for me. I'm the type of person who feels bad if someone gives me too much change and I'll always point it out to them. The idea that someone would want to be sneaky and rip off a seller does not sit well with me. YES, I know you have now contacting the seller....but that was only AFTER you found out what your legal options were. Shady, shady, shady.

IT may be harsh but I mean every word I wrote. I don't tolerate people that seek to steal or harm others knowingly and willingly. There are already too many slime balls in this world and I don't feel like being nice or encouraging another one. :monkey4

I bought a cap recently and the same thing happened, me being me emailed the seller immediately and said do you realise you sent me 2?, they thought it was hilarious they had made the mistake and just told me to keep it.

Obviously its different with a more expensive item but the fact that your first post about the subject was this:

I know (according to Belgian law) that who has the actuall posession of a item, is automaticaly seen as the rightful owner of the item. Unless of course the party who claimes to be the real owner, can actually prove he is the owner...

But what must I do in this case?
has the seller have any ground to prove he is the owner?

If you see someone drop a $20 bill and they don't notice, it is not ok for you to pick it up and put it in your pocket. Its immoral and indecent but maybe not illegal.
Here is a seller who performed an honest transaction with you, then he makes a mistake. The person who was supposed to receive the item is distressed because he paid for it and wants it, the seller was trying to do yet another honest transaction, and if you keep the item he will have to compensate the buyer and then he's out the money. It astonishes me that you have to mull this over.
it doesn't matter if its $5 or $500, wrong is wrong, the idea that the dollar amount dictates moral or immoral is utterly absurd!

Yesterday I received $20 too much change from an automated checkout. I took the extra cash to the desk to give it back and everyone looked at me like I was nuts for giving it back. It should be the opposite, and we should expect people to be honest and not dishonest.
Now you may feel you are being attacked, but I would hope you would look at your actions and and way of thinking adjust them.

I agree.

I work with a guy who once found a wallet a customer dropped and he took the money out of it but returned the empty wallet when the customer came back. He said he was "entitled" to do so because it was the guy's fault for being so careless with his wallet in the first place. Unfortunately I never got the customer's info otherwise I would have let him know about being ripped off. It's amazing what some will do and say to rationalize their behavior.
 
Riko, I'm not going to hit you over the head with my principles or anything of that sort, but I find it incredibly stupid that you posted this sort of thing on an open forum for everyone to read.

It's like you willingly threw yourself into the snake pit, or lion's den and expected them not to rip you in half.

That is because living in Belgium is a joke, a bad joke.
Just try to follow how our politicians think/act and you see what I mean.

No kidding.. I think I am going to take my next vacation there... and bring a LOT of empty suitcases. :)
