Because it's not a Fox production, it's a BBC production. Fox owns Buffy and Angel because they produced it. They only licensed it to the WB and UPN. But Ripper is a completely new deal between Joss and the BBC. The BBC might have to pay something to Fox to use the Giles character, but Fox will have nothing to do with the production.

That was Whedon's big annoucement at his panel I'd say. He was pretty confident it was going to happen so I'm sure it will.
