Ink only said your line up wasn't the Avengers because it included Spider-Man and Wolverine, he doesn't like New Avengers line ups, just Classic. As of the AvX storyline when Hulk rejoined the Avengers, Cap, Thor, Hulk, Wolverine and Spider-Man (and also Doc Oc in Peter's body) have all been on the same team of Avengers at the same time so you're 100% right, they are Avengers.
