Characterization:
Batman should be an urban legend. The people of Gotham know about the signal, and the GCPD knows about Gordon's late night visits to the rooftop, but, outside of that, no one's ever seen him. Batman should be something you see illustrated depictions of on Weekly World News, rather than photos of on the cover of the Gotham Times. I want him to be primal, almost, when it comes to fighting. He moves so quickly that criminals don't know what hit them, and they don't know if what it was was human or not until they see him walking away. To be frank, Batman's existence should be hearsay in Gotham, and that's why he's not mentioned in the other films, outside of Wayne Enterprises stuff.
That being said, following the events of Man of Steel, he realizes that he needs to change his tactics; Batman needs to step into the light. In my mind, I think. That Batman should form the Justice League, and I think he should do it because of his own paranoia. Batman should form the Justice League as a way to keep tabs on the meta humans, while also gathering intel about their weaknesses. This could set up a Tower of Babel scenario in a future sequel, while also vindicating the events of Man of Steel. It would answer the question of "who could possibly trust a being who leveled an entire city in the process of having fisticuffs with his enemy?" The answer: not Batman.
If they did go through with Hamm, though, that would also show fans that they aren't trying to restart the machine again, but, rather, pick up with an experienced Batman who's been around for a long time. He's gone toe-to-toe with his rogue's gallery on multiple occasions before the film starts out, and, personally, I think that's what I'd like to see. We already know how it started, but we never really get to see him in his prime (maybe even a little after it).
