Celebrities want a fairly ridiculous amount of money for use of their likeness. Well ridiculous when it comes to producing action figures that could be manufactured and turn a profit. I know of a company that tried to sign a deal with Patrick McGoohan shortly before he passed to do a Prisoner figure. He wanted $10,000 up front plus a percentage of the profits from a company that planned to do 300 to 500 figures.

whats your point? If you don't like their price point then its ok to steal their likeness?
 
Nope, he's responding to the post earlier about it being easy to acquire a star's likeness rights. That doesn't sound "easy."

oh, ok. I guess I am just confused that the people who have no problem stealing the likeness of characters and actors, are upset when their work gets stolen. I mean I don't like recasters, but I don't get the moral high ground some people seem to be standing on.

Depends. In Cali, actors have rights to how their likenesses are used. Schwarzenegger sued a parody bobble head maker and won, even though there's an "elected official" clause to allow for political parodies. Though I'm sure there's a "but if in public" clause that allows media to publish photos.... though calling tabloids that is a huuuuuuuuuge stretch. :lol

The point was that people have tried to license likeness rights from celebrities before. Custom figures end up happening because it isn't practical for a legitiment company to produce figures when they can't turn a profit. Stealing a likeness isn't an accurate term. Custom artist are borrowing a likeness for sculpture reference. Stealing implies that the person's actual likeness has been removed from thier head. I get what you are saying though. Even c list celebrities probably carry around more folding money than they would ever make from royalties on a custom head. When you get into bootleg companies that are creating 40 - 50+ figures and selling them for $300 to $800 each is where the financial reeming begins to be felt by those losing out on royalties. In the garage kit world there was a famous case of a guy who was selling unlicensed "66 Batman kits. He was claiming that the actors sign off on okaying the kits. Warner Brothers was going to prosecute him until they figured out the guy didn't have enough money to cover court cost or attorney fees.
 
Just got up and man, this thread has progressed through a couple of pages :panic: had to drive to work and read through some and skipped most of it since its just too much reading for the morning :lol but i did manage to see the list ecko compiled, and noticed emarae bought a recast from Q, this month. Wow, i thought most members should know better by now not to give Q business :huh

No mods on that list too, at least none that i know of.

Not sure if serious? I was trying to help you make your point. I think it would be interesting to see a trial were it was being determined if a sculpt looked enough like a celebrity to convict the sculptor of "stealing" a likeness. If the jury was half as picky as some people on here the sculptor would skate free and clear.
