I opened my case against that tool on eBay for his "Like New" game. Even eBay's description of Like New is against him (I hope):

Like New: An item that looks as if it was just taken out of shrink wrap. No visible wear, and all facets of the item are flawless and intact. See the seller’s listing for full details and description of any imperfections.

Nowhere does he mention scratches in his auction. Just that the item is in LIKE NEW condition and comes with the original instruction booklet.

Sellers are such Richards ! I submitted an offer. The guy accepted on the 3rd and filed a non-paying bidder thing against me on the 5th !

Even in his listing he states that payments must be made in 3 days. 3 + 3 = 6 !

Damn this new-fangled mathematics thing !

Nice that I won, but they don't give you much time to ship it. It's also pretty crappy that I have to foot the bill to ship it back.
