It is illegal where scalpers don't pay INCOME TAX on the profits they make. If you want ILLEGAL, That's ILLEGAL. Scalpers are operating a business under the table, illegally, depriving the government of due taxes on profits derived. Tell me how you pay income tax on all of your scalping sales. It is WRONG because scalpers are buying things they don't really want, just to sell them to those who do, in order to make money illegally by selling things at an enormous profit, with no overhead, and then not paying taxes.
Scalpers who resell concert tickets are conducting an illegal business for the same reason. That is why ticket scalpers are often arrested selling tickets, are they not?

By using your logic garage sales, sports card collectors, and artists are all doing things that are both illegal and wrong.
Not my logic, the US Government's logic, I'm sure. People who scalp collectibles should be treated the same way as people who scalp concert tickets, period. You can't apply the same reasoning to artists, because they get paid in compensation for their LABOR, and not profit. How much is their labor really worth?

You obviously have NO IDEA what you are talking about. Laws regarding scalping of event tickets are different and vary from state to state. Majority of which DO NOT prohibit scalping of tickets, but they do prohibit the scalping of tickets within a certain area of where the event is being held. for example, it may be illegal to scalp the tickets within 1000ft of the event center, but it is NOT illegal to scalp for higher than face value.

And the flipper debate really is a moot point... flippers flip because the buyers are there to pay extra. Even if you don't like it, its still going on and not much you can do except not buy into it.

You first said that since scalping tickets was illegal (a misconstrued generalization), that scalping collectibles should be no different.

... I speculated that the reason scalpers are arrested is because they are avoiding paying taxes. I ASSUMED. I have heard that scalpers are arrested, and figured avoiding taxes is a reason.
