Who owns their Superhero/Villain role better? Is Heath more Joker, or is Robert more Tony Stark?
How many different roles do you figure RDJ will be remembered for by the masses when all is said and done? His forgettable Sherlock Holmes? The Chaplin that probably 10 boardies total have seen? I'm not saying Ledger was a better actor or anything, but really, folks know RDJ for Iron Man just as they know Ledger for Joker. Neither of these guys has a Gary Oldman type resume. Can't vote for a dead, guy, sorry Heath. RDJ is more relevant at this point and time. Heath will be remembered for ONE role.
Well. . .I would vote none of the above, because both took such significant liberties with the source material. They are both great, memorable performances, but having grown up reading and loving the comics first, Ledger ain't Joker and RDJ ain't Stark in my mind.

Heath does a great Tom Waits impersonation, but RDJ's Iron Man is much more interesting.
Man, whiny crybaby Alfred might be the #1 reason I haven't watched Dark Knight Rises again since seeing it in the theaters.
