A real lawsuit almost happened. The rights holder to the Escape films went after Kojima, but they were dissuaded by John Carpenter because he was a fan of MGS2. While the news wasn't heavily publicized, Kojima/Konami dodged a bullet with that debacle.
Food for thought: Imagine how bad thing could have went, considering people have won lawsuits over ripoffs much less blatant.

After the debacle, Kojima went on record to contradict his origins of Snake. I still have the magazines where Kojima specifically mentions that "Snake" was indeed derived from Snake Plissken, all the way to his personality and eyepatch. David Hayetr also recently said Kojima wanted Kurt Russel to voice him in MGS3, yet here is back peddling on the whole affair:

As much as I respect Kojima's contribution to the industry, the man has become a hypocrite and has consistently proven that he could not own up to anything he says.
I would just love to see the fan reactions if Kojima was sued by Carpenter, and he actually succeeded. I can imagine them defending Kojima and saying Carpenter was in the wrong.
I'm not sure there's enough to win a law suit... Not that the characters aren't similar but in media every character is a copy of another in One or many ways.
I think Plissken is more of a rogue and more of a "bad" guy

He also sucked at espionage, was caught stealing from the Federal Reserve, and got put into the slammer. Sold Snake at least avoided jail time and knew how to do it .
One thing I've noticed, was that a lot of young kids got into MGS around Peace Walker's release in 2010. And even more with the announcement of MGS V. While I don't mind new fans, it's their general attitudes and argumentative demeanor that's a ****ing turn off. The fact is, if someone recently got into MGS, they aren't as invested as those who have been with it since the beginning, and it's pretty presumptuous for them to act like they are. But, it's not just limited to MGS, the same goes for any series - whether it's Game of Thrones, The Walking Dead, etc. Fair-weather fans abound, they desperately seek approval from the "big boys", and they feel themselves entitled to a level of respect that wasn't earned.
I'm just thinking, Pliss recently got me into Berserk. I like it a lot, in fact, it's one the greatest manga series I've read. But, I'm not in the discussion forums, arguing it out with fans who've been with it for much longer than me, or providing my unique perspectives on the future a series that I never cared about, or the creative direction of the author that I never knew about about, until recently. I know there's at least one former member, who was like that with MGS - "she will be missed".
I think it is really around Peace Walker's release that the series got more interest, might have been due to the PSP or something. Not quite sure why...I saw a lot for MGS 4, but strangely it may be Peace Walker. But you're right on those kids, my god. Christ I don't want to open up that can of worms again, but there's plenty of those douches in this place. I don't know why one needs to latch onto a person on a toy forum so hard and constantly lap their ass. One would assume, outside of a toy forum, their lives are very void of anything.
And speaking of "she", I think it's back and all the boys are swooning in the movie section. Nothing but predictable rubes.
This reminds me. There's a Berserk reddit and a fan site forum which are run by the same people, and I utterly refuse to post in there. They've been in it for 20 years and the place utterly reaks of arrogance. I don't put myself in a place where I know more than them, since they've been able to mull the series over for well over a decade or more. I'd prefer to just read theories than getting in the middle of it.
