Ok , so ABC epxress charged me for one figure and it came perfect. DONE.

I also bought another Joker a while back with a completely different company and thought I canceled it. Another joker arrived and I presumed I did pay for this one too and sold it off as now I don't need another.

Now it turns out ABC express may have sent out another joker by mistake and now want it back after I have sold it cheaper than they will want back plus postage.
 
How did you not realize that the 2nd figure was sent from the same company. im sure it came in the SAME type of packaging, with the SAME return address label. :lol
 
I didn't even look because I always take the packaging off before leaving the damn post office , this is why it sucks even more.
because after the post office I needed to go out so took it out of the oversized shipping box and just held it thinking why the hell have I got another joker.

So, you were OK with thinking you had paid for it when you thought it came from the other company by mistake (after you had canceled the order with that company), but you're not OK now paying ABC Express for it? I'm not getting that.

The poor thing better be careful she doesn't poke her fake ****ages with those fake fingernails and have fake goo all over herself! :D
 
As I'm reading it, you only have yourself to blame.

ABC sent me two of one figure once. I knew this sort of thing happened because I had read about it on the boards, but never thought it would happen to me. It was a pain, but thems the breaks. Was I going to keep it. Hell no. I wanted one, and I paid for one. I didn't want the other. To keep it would be dishonest. I need ABC to supply me with otherwise hard to get items. They look after me, so I look after them.

I know this isn't exactly what happened to you, but you have to take some responsibility. Responsibilty to correct a mistake. YOU mistakenly sold it on. Had you bought two, you would have paid full price for two. If, as you say, you didn't want the second and sold it for half. You would have accepted the 'half' payment, had you actually bought two to start with. You thought you had paid full price, but were willing to sell it for half. Why not now. Now that you realise what happened. So I would suggest you pay the full price for the second figure.

You should keep tabs on what you pay for, what you pre-order, what has come in, and what hasn't. You should have known that you hadn't paid for the second figure, and you should have realised that something was wrong, and you should have checked and made sure before you went ahead and sold it. So now you find yourself short. Best thing you can do is set things right. Communicate with ABC and explain that you can't pay them back straight away. Suggest to them how you are going to pay them back. Either you do that or forget about buying from them again because you'll likely get blacklisted. You may wish to ignore them and hope they'll go away. You will be dealing with credit card companies, because, even though you may have excuses or say you were double charged, eventually they'll get to the bottom of it. You will be the one to suffer in the long run. The person at the credit card company wont be the one you deal with, as they turn over staff. Thus you will be ground into the dirt, while they remain fresh and on target.

Pay up or pay the consequences.

like others.. i've never had any problems with ABC Express. they've always been reliable (so far).
 
Here in the US you are not obligated to return an item if it were sent by mistake but I've always called to find out what happened. I don't mind sending an item back if THEY pay for it. 9 times out of 10 they'll just tell me to keep it. I have been asked to send an item back at MY expense and then they'd reimburse me, but I always refuse that. They'll usually send me a return label or something then.

I would never judge Hicks either. Not my right too. Actually, I'm not sure I have the whole situation right. I'm alittle confused by it all. But that might just be me. :duh

The only thing I think some people are trying to say is that, even if you (and I mean the generic "you" ;)) are legally "in the right", that doesn't necessarily mean you should exploit it to your advantage. The law is there to protect people from some forms of mail fraud, not from honest mistakes made by someone in a shipping department somewhere.
 
I have to agree with The Ween, RoboDad, GordonGekko, and Creech on this one. You do have an obligation to keep track of your pre-orders and the items for which you've been charged. Ordering the same item from different dealers--especially overseas--is rarely a good idea because confusion typically results from it. Chances are that the second dealer (which was supposedly cancelled) may have been another seller ID for ABCExpress, and that is why this happened. Morally, you have an obligation to make attempts to confirm and clarify what has happened.

Simply saying that you will keep the figure is not a good idea on several levels:

1) If the root of the problem is your own misunderstanding, then you are at fault and responsible for either paying up or shipping back at your own expense.

2) Taking this position does cast you in a different light amongst board members with whom you may want to do business with in the future.

3) You will likely be blacklisted by ABC, and negative feedback will likely be left on your eBay account.

If they genuinely screwed up, then insist they eat the cost of return shipping up front because it was their mistake. However, you need to return the item--regardless of whatever technicality and/or loophole you can exploit.

As for this whole business of selling that other Joker--that's the part where it gets fuzzy. You have your Joker, a Joker you sold off, and then a Joker you supposedly cancelled? Isn't that THREE Jokers? How could you have sold off something you cancelled? Or did you sell off yours?

That's why I always call. I'm too afraid of being charged for two. It's a hassle trying to get anything removed from your card.
