You're right. Apparently upon further research the agreement between Sony and Marvel is not to split the profits so Sony doesn't benefit from the usage of Spider-Man or his characters in Marvel Studios banner films and Marvel/Disney doesn't benefit from Sony's Spider-Man films despite deferring creative control to the Marvel Studios team, other than the licensing fees originally. So if essentially if the studios are allowing each other to do their own things and rake the profits it would make the exclusion of a Spider-Man figure from this line a little more interesting.

They did have the rights but that's not still the case. Part of the deal to allow Spider-Man into the Mcu and marvel studios to have creative control was that Sony reaquired most of those merchandise rights.
