Easy. they could've put their money where there mouth is and said

"THIS IS UNACCEPTABLE FROM A QUALITY CONTROL STAND POINT. ROGUE HAS BEEN DELAYED SORRY FOR THE INCONVENIENCE. THE 10% NRD DEPOSIT THAT YOU PAID 9 MONTHS AGO GUARANTEES OUR LOYAL CUSTOMERS THE PRODUCT THAT THEY INITALLY PREORDERED."

They pigeon-held us with the NRD, and when we fall on hard-times we are told "too bad so sad, we are keeping your 10%". Where is the consideration? Im certain what they did was not entirely legal but they pussyfooted around the issue by playing deaf dumb and blind irrespective of the fact that all waitlists were closed a month in advance.

What about all the other preorders that we were FORCED to accept an NRD?

NRD should be abolished if they dont live up to their end of the bargain. Thats what contract law states, both parties give up consideration. It seems very one sided to me.

Well, I would have been pretty happy at least if they told us that the sculpt from SDCC for her back was going to be changed and asked us if we still wanted to keep our order like for Nightcrawler CQ. Then at least it would have not been a shocker after it shipped.

NRD should be abolished if they dont live up to their end of the bargain. Thats what contract law states, both parties give up consideration. It seems very one sided to me.
If you send the item back for a full refund for the reasons you state. . .then you get the NRD back, though.

well just to enlighten some of the stateside fans here.

International customers are responsible for all other misc. costs, duties and exchange rate conversion fees. Banks and financial institutions can charge up to 6-8% even if we decide to do a refund. If the product is displayed on the website and that is what we were under the presumption that is what we'd receive, they better damn well be sure thats what we are getting..

I hav 6-7 NRD preorders and although SSC reputation is great, I am less confident in future pieces.

nobody is even talking about one of the worst things about it...the grossly overpainted lips. On the eyes...how do they screw up such enormous eyes? :dunno

Like I said it before, the powers behind the scenes requested the changes! I just got this confirmation from Sideshow:

Marvel requested changes to the sculpture on the portion of the costume that lays across Rogue's back end. They preferred the material to be represented as stretching across the backside as the costume would actually do, as opposed to how our original prototype represented the material tightly hugging the individual curves. We believe the change actually enhances the sculpture and apologize that the back of the figure was not properly shown in the final gallery photos.

Unfortunately the prototype that was displayed at the Comic Con is not available and all pieces that are manufactured and distributed will have the altered sculpt. Going forward we will do our best to ensure that our customers are aware of any changes that maybe made to the final production pieces and update the galleries online so your can make a better judgment for yourself.

If you do not wish to keep your statue in light of this change I can forward your information to our Returns Department and they will be able to assist you in starting a return"

Not sure if anyone has posted this, but I emailed Sideshow Customer Service about the change in Rogue's "backside" and here is the reply I got back:

While I am still not happy about the change, I appreciate the explanation and the option of returning the statue if I choose to.

I'm not sure that I see the relevancy to your argument about the NRD. You are getting the NRD back if you return, which is what you said should be abolished. Even if Sideshow did abolish the NRD, you wouldn't know the quality of a piece until you got it in-hand. At which point, you still encounter the precise set of cost issues that you discuss and NRD plays no role whatsoever. I can sympathize with your concerns over not getting what is shown in preview pics, but the NRD issue seems irrelevant to the issue here.

we've gotten over the ass ... its done. the paint is horrible

Did Marvel request those changes as well? Think its a bit counter intuitive that they'd want a reduction in the ass curve, but they'd request her too look like a pupil dilated sloppy crack whore looking for her next fix.

She's probably related to this guy...

Ill make it very simple for you

Refund for international customers means

Refund from Sideshow + NRD - 8% for currency exchange rate fees.

Its not a 100% refund. You still are out of pocket at least 8%. On top of that you are out of the INTEREST on your 10% NRD that SSC had for 9 MONTHS INTEREST FREE.

Yeah, they had more than enough time to inform customers of the change especially since it was in both their videos and displayed in SDCC.
