The Zeck Punisher. I remember when that mini series came out.

Yup! That mini series was fantastic and Zeck's Punisher will always be my favorite. The urban Rambo that he was turned into just isn't for me.

Zeck is the seminal Punisher artist. His covers with Zimmelman were attention grabbers. I have been a fan since then and still have all of the posters up on my walls. Also use it in my avatar

So I won an auction on ebay for a sideshow vader for a good price and the seller sent me this figure instead. I did a paypal resolution center filing and also messaged the seller to get the vader figure sent to me or get a refund but the seller has not responded to me yet. The figure was in sealed sideshow shipper but.I did open the shipper just to make sure the seller did not put the vader in the punisher shipper. How much would I be able to get for this figure if I sold it here on the forums. I am debating on cancelling the resolution center claim and sell it on here if i can at least net back my total price I had paid for the vader if the seller does not respond back to me.

Not worth it. This Punisher sells for less than Vader. Plus the hassle of trying to find a buyer, shipping it out, paying for ebay or paypal fees etc

I agree, I would try to get the Vader from the seller. It's actually a very nice figure. Better than the Punisher you received anyway (my opinion of course).

Not sure if I will be able to get the vader. The seller had two auctions going at the same time, the figure I received and the vader I had won. I think they put the wrong shipping labels on each package so i am guessing they would have to get the vader back from the other buyer and who knows, maybe that buyer ends up wanting to keep the vader. I won my auction for less than what they paid for the punisher figure. Also it has been a few days and the seller has not responded so i opened a return dispute in the resolution center yesterday. I wonder if their ebay email is one they don't check often.

Hopefully the seller responds to you and at least offers a refund to send it back. That would be the right thing to do anyway. If you filed a complaint my guess eBay will side with you since you were the buyer. They have a habit of doing that regardless of who's in the wrong. In this case I don't think you have anything to worry about.

I also provided pictures in my complaint that shows the punisher box and also shoes the shipper box that says punisher figure on it and it also shows the shipping label with my name address and the sellers name and address on it. If the seller doesn't respond I believe ebay will send me a prepaid return label and then when it is sent back ebay would reimburse me then go after the seller. Although I would prefer to get my money back first then I would ship it back as I do not want to wait the week or more after shipping it out to get my money back.

Ebay will side with you 100%. You will get a refund and a return shipping label. Nothing will come out of your pocket. However, you just have to find a new Vader figure.

Well the seller responded to my first message to them and blamed fed ex and said they could give me their other buyers email and we can just send each other our figures which I won't do because nothing is stopping the other buyer from not shipping the vader to me and then keeping both. Also they seller did not say they would provide me the shipping label or money.

Then they responded to my paypal dispute request saying they must have mixed up the labels and said they are waiting to hear back from the other buyer. I think the only solution that covers me is to have the seller/ebay give me a return label and the same for the other buyer then the seller resends us the correct figures or provides refunds. I know this will cost the seller more by having to pay for shipping 2 more times but that is the cost of them not being careful on shipping.

Yeah it's on the seller, not you. You should not have to pay anything else out of your pocket for the seller's mistake

It's totally on the seller. I did the same thing on accident with some legos recently and ended up just giving them full refunds and letting them keep the wrong sets (left it up to them if they wanted to ship them to each other). I lost out big time, but since it was my mess up, I figured it was the right thing to do.
