Magazines have long lead times before being printed. They may have had to use the V.1 head because BR Joker's regular head wasn't done yet.
Yup.. but not only that: I hope people understand that big companies also use Photoshop or other photo manipultaion programs too. I see people all the time saying "That's Photoshopped" and then automatically jumping to the conclusion that it's some private individual who did it. That assumption was made in this thread for example. Look at some DVD covers or Movie posters or even magazine ads and you'll see some truly horrible PS at work, and that's "professionally" made. So don't always assume that Photoshop/photo manipulation automatically = someone at home making a joke or pulling a prank. Sometimes it's actually from a company with lazy ass, talentless workers in their art departments.

For me, based off that ad (how the pics are lined up) I took the slicked back head (what it's now being called) to be the "Smiling Version". Not that other head (repainted v.1, old version whatever you wanna call it). The slicked back hair head is front and center and in the majority of the pics in that ad. Its the "centerpiece". So for me, imo THAT head is the "Smiling Version". Even now with the most up to date pics.. the new sculpt is dead serious.. so the slicked back hair head is still the "Smiling Version" because compared to the new sculpt and the v.1 (which has a kinda dumb, slightly open mouth) that head has the most "smile".. even though it's more of a half grin. Realistically HT could have just sold the figure with THAT head, mask, guns, duffle bag and new outfit and people would've still bought it. iunno..
As long as when I get it from Joe it looks like or similar to this:
