I guess the first come first service business practice is thrown out the window? eh...

Not really. This is the email I got from Chris two weeks ago...

Friday, June 12th...
Regarding the House head: "I just sent out a batch, If you weren't in that then yours will be going out tomorrow or Monday. That takes care of all the unpainted."

As you can see, according to Chris, mine was supposed to be the last head shipped of the people who ordered unpainted heads. If he had "just sent out a batch," those people must not be forum members here or at OSW. Or maybe they got the heads, but are too busy or disinterested to post them. Maybe they are Chris's eBay customers. Or maybe there was no batch. Who knows?

I'm sure they would be posting because as we know both forums are eager for any information which still remains one so far?

Well, I was one of the unpainted (or a refund) and I have heard NOTHING from him. Emailed him again today. It's now the 27th.

I am sort of a newbie and caught a bit of this post and my Q is why are there so many members waiting for Chris to reply ?

I am only asking because I have been interested in his work and were thinking of getting some work from him but i don' t think I have ever seen anyone in the past or lately post any of his work ?

Confused

He'll be glad to take your money, I'm sure, but heaven only knows if you'll ever get anything. I would wait until (and if) it seems like he is actually filling the majority of orders, and even then, at this point, I would in no way purchase anything sight unseen. He has treated the people on this and the OSW forums like we are way less than houseflies to him. Be very wary.

in for over 100.00 in hs from Chris and havent heard a thing. Ive sent him pms titled the way he said to and still nothing. :( I probably wouldnt be worried if it was just 35.00 but now Im wondering if Ill ever have the product or my money back.

I have only been a member of this forum for a short time and from what I have read on others that got backlogged as long as they were trying and keeping people updated on progress members are more than forgiving and happy to wait.

When Chris graced us with his presence a couple weeks ago with his snide remarks about not being patient and trying to divert blame to everyone but himself is totally unsatisfactory.

I for one am tired of waiting on him and will be doing what I have to do to either get my money back or get what I paid for.......

It's just a damn shame the amount of damage Howes has done to the customizer community as a whole.

I just sent him one last email requesting my refund within 3 days, or I'm going to file reports as well. I think it is probably time for all of us that actually paid money to organize and file these reports together, so law enforcement can see the magnitude of people he has stiffed. I bet his local newspaper would like this info, as well.

He's quickly becoming the Bernie Madoff of the toy world.

Has anyone tried file a complaint with paypal and trying to get your money back? I am not sure what the length of that is through paypal that you can attempt to reclaim your money.

I do believe that is the problem. I'm sure it is 45 days.

What types of Buyer Protection does PayPal offer and how am I covered?
If you pay for an item using PayPal and you have a problem with your purchase, we have two programmes to help protect you:
PayPal Buyer Protection (for eligible items purchased on eBay using PayPal)
PayPal Buyer Complaint Policy (for eligible items purchased outside eBay using PayPal)

PayPal Buyer protection

PayPal Buyer Protection offers full protection to buyers who pay for their eBay purchases using PayPal.

If you pay for an eBay item through PayPal and you have a problem with your purchase, then you are covered for the full amount (including postage) in the event that:
You don’t receive the item
You receive an item but it is significantly different than the description on eBay

To ensure you are covered you must:
Purchase the item on eBay using PayPal
Use the 'Pay Now' button when the listing closes on eBay or associate a PayPal payment with the eBay listing by entering the item number during the Send Money process
Ensure the claim is for tangible, physical goods that can be posted and are not prohibited by eBay or PayPal
File a dispute in the ‘Resolution Centre’ within 45 days of the payment. If the dispute can't be resolved, ask PayPal to investigate by escalating the dispute to a claim within 20 days of the date the dispute was opened
Be willing to provide information during the investigation process. If we are unable to obtain the necessary information, the case may be cancelled without a refund
Only open one dispute per PayPal payment

Click here to read the full terms and conditions of PayPal Buyer Protection.

PayPal Buyer Complaint Policy

The PayPal Buyer Complaint Policy applies only to items that are not received and which are purchased outside eBay. Claims regarding the quality of goods received are not applicable.

If PayPal decides the claim in the buyer’s favour, the buyer will receive a refund only if there are funds in the seller's account.

To ensure you are covered you must:
Ensure the claim is for tangible, physical goods that can be posted and are not prohibited by PayPal. Payments for intangibles, services, licenses and other digital content are not protected

It is 45 days but if people still filed a complaint even though paypal would not do anything it does go on his account and when so many complaints are received they will lock his account....

If you payed on paypal, and used a credit card, you can still get your money back upto 6 months later.

Trust me, I've been in this situation before, I always pay with credit now, you just need to call your credit card company.

Just one thing, once 3-4 people get refunds, paypal will close his account down for so many complaints. So if you miss out, your screwed.

Looks like we are pretty much screwed anyway....If he withdrew the money from paypal there wont be anything to refund with so people should still file a complaint with them....

This crap is really bumming me out..
i really wanted that painted house head and cane..
it was for my brothers birthday/christmas gift. My first custom figure to boot.

What a sad experience..
I just sent him another e-mail trying to see if i could get anything. But it is looking worse and worse.

Whats sad is that there only seems to be a handfull of people on this board that think theres an actual problem.

This has happened to me before, and this is how it goes… Pay pal will refund you and request the money from the seller, if the account balance doesn’t cover it the seller is asked to deposit sufficient funds to cover it, if they don't comply Pay Pal sends it to a collection agency.

I was going to try and call my credit card company, even though it's been more than 6 months, but when I looked back on my paypal transaction history, I apparently used an existing paypal balance to pay him. That's a pretty unusual thing for me to do, but unfortunately I did it, so I'm basically at his mercy.
