Hi Dhaval, i remember the thread that was opened by the Seller claiming that HE had been stung by you! I made it quite clear that i wasnt taking sides as it was extremely difficult, even from the pics, to tell which of you was telling the truth. I also remember him making a promise to you, just before the thread was closed, that he would honour the transaction and refund you as soon as he had recieved the damaged statue. However, before we can make judgement on the seller, we have to give him the benefit of the doubt, is he on holiday? Did he sign for it personally? Is he aware that it has been returned? I know you have tried to get in touch with him but i'm not sure how long you have given him to respond to your messages - at least 2 weeks would suffice in my opinion. If it has been over the 2 weeks then it is totally unacceptable that he has now gone against his word and not re-payed you....and maybe this at last can give you the answer you were looking for all this time...that the statue was damaged in the first place and you were telling the truth from day one. My sympathy goes out to you Dhaval, as i said in the other thread, let this be a painful learning curve my friend...best of luck in resolving the whole thing.

Bro. i have conversation between me & him its clear he got statue .......20 days for what??? its been delivered & now i m waiting for refund. paypal reversed payment of 540EUR out of 640EUR. now i m waiting for seller to make refund of 100EUR ........ clearly he didnt made refund instantly after receiving statue as he promised to me ....

if thats the case that he has recieved it and now he is refusing to pay the refund that he promised then thats low of him. However, looking at the bigger picture Dhaval, you have come out of this whole experience as the better man and the honest man, it may be little consolation but i hope that makes you feel a bit better :grouphug

I was searching for the right emoticon to show as a description of what you'd like to do to the seller if you ever got your hands on him....:thwak

Glad it ran...first time I saw this issue. I know not to deal with this seller now.
 
Paypal reversed payment of 540EUR so i will get 540 EUR within 30 days. Just called to paypal about 100 EUR they said ask seller to refund direct to me since i was unable to open dispute for 100EUR ......

the majority of the problem is solved. you also posted that you've PM'd the seller about refunding the remaining $100. the thread has more than ran it's course
 
I am the seller of the Gambit statue.
This has become a big joke.

Dhaval has been refunded.
He said he would settle the remaining 100 with his credit card company.
I'm not refunding him anything, to see it later get charged via my CC also.

I don't trust this guy one bit.
I'm still not 100% sure he didn't allready have a damaged one.

You should see the coloured box of the statue I received back.
It's completely dented on all sides and has been taped with brown tape !
I can hardly believe that is the same box as the one I sent to him.
I should file a new case with PayPal, because of this !

This is the last I have said about this transaction.
I will never sent outside of the EU again and certainly not to India.

Dhaval wants to settle this with his CC company, so be it.

he said hes contacting his CC company because u wouldnt refund him his money,which u promised, wat other option did he have?its quite clear u dont have any intention of keeping ur word to him and want him to go through the trouble of a 100 paypal calls and cc company calls and the time,
if u didnt have any intention of refunding the money urselves , u shouldnt have made the promise to him that upon receiving the item u would refund him,if u wanted the Paypal and CC company to handle it , u shouldnt have promised him anything in the first place,its clear that u want to keep watever money u can now

I asked u for 100 Eur refund from you as u promised & stated ur honest now i seriouasly doubt that ur telling me brown tape is problem r u mad or what i made sure statue dont get damaged during shipping . & i have all pictures of box before shipping i will post pics tonight to clearify that. how u r saying u should file case man u cheated on me ........you have to refund 100EUR as u promised..... I m really frustruated with this deal you dont care about your dignity man .... u have said u will refund me money that u should after receiving statue......

This whole situation reminds me of when i was really into the Super NES game Mike Tyson's Boxing! You'd manage to win the 9 exhausting fights before coming up against Iron Mike and no matter how hard you try..you could never beat him. Just one punch from Mike and it took out over half your energy level, 2 hits and your out....KO! Ah Man...so fustrating :cuss
 
damn i trusted on u Vince :slap ..... i thought matter will be solve after you receive statue u will refund me but u didnt even cared abt me.....

see i dont know how u still thinking that i have another gambit & for ur kind information the box u sent me is not packed well u just covered name on brown box by yellow paper ....i have asked u to use other box or brown paper to cover it but u didnt. i used brown tape just because it wont get more damage just for precaution.
 
You're out $100. He's out a whole statue because, in trying to help you, he insured for a lower value than it was worth, and you did not honor that agreement.

I imagine that is extremely frustrating.
 
Things to do to avoid scams or headache!

Some of you buyers out there. When you buy anything things to protect you from potentials scams.

1) all corresponding emails should include the ES number. Make this clear!
2) when you sent payments to the seller, again have them state the ES number.
3) keep all emails until package arrives safely.
4) take pics of everything which includes boxes and ES number if the statue you receive is damaged. I do this when I sell stuff too. Make sure that the statue pics are clear and have not be obscure by an object or something like that.
5) Depending where the statue is shipped from, request special handling like extra boxes etc.
6) Insure the statue at full price.
7) delivery confirmation or signature required.
8) When you sent payments, pay with your credit card. This is double protection if PayPal declines your request of refund or your 45 days Protection plan expires.
9) pay in Paypal goods not gift! You are not protected by PayPal if you sent payments as gifts.

Do this and you will have less headache!

not 100$ its 100EUR which seller should refund me & 230$ for customs & return shipping. he didnt tried to help ok he just wanted to get rid of damaged gambit statue & tried to solve matter with partial refund thats what he did.... & after giving word that he will refund full money he just back off thats called frustruating
 
Should this flame war be allowed to continue?? Both sides have had their say. There isn't going to be a resolution here that I can see. This is just ugly.
