I sold an item for 300 dollars on ebay. UPS must have not scanned my package. 2 weeks had passed since the original estimated Shipping date and still no tracking update. A case was opened and I lost. BUT I stalked the seller for sale items. About 3 days after I lost, my item was up for sale on ebay.

How recent was this? Did you file an appeal? I used to work for eBay in their resolution center and I'd see this situation quite often. If you're within the timeframe and you haven't already, you should definitely file an appeal. If you're serious about it, CALL eBay rather than file an appeal online. Hope you can get some sort of help.
Same thing happened to me with an iPad and I lost, and the person clearly had it as it was listed a couple weeks later with new pictures but also with ones I had used!

I'm thankful I was able to score an EX a few weeks ago, but I'm starting to wonder if this thing will ever start shipping. The port strikes suck.
