I get the photoshopped background is from the iron man fight. if you've seen the film which figure actually fits that scene better? The cap figure with the face that is in fight mode and the shield to match, or this one that has the scratched shield and stoic face? The background is just a cool look for the pictures.
The other figure has that same background in some of the images, and the figure actually fits the film in that way. This figure matches the earlier scene. Forget the background. Just look at the figure, since it doesn't actually come with the background. The battling version matches the black panther scene (hence no bloody face) and the regular version matches the final scene.

Though it is weird that his shield does not get cleaned up like it seemed to do in his other previous movies (cap gets into a fight and shield is def weathered but looks clean when the fight is over or in the next scene). My only thought other than what you mentioned and to fit into the story would be that since BP's claws are vibranium (his suit is so his claws could/should be the same material) and it leaves a lasting effect that cannot be easily fixed. Vibranium on vibranium.Yeah your correct. That does happen in like every movie. Lol
It's probably mostly just an oversight. Many people working on it and all that. But it's also possible that it's done on purpose. To make the shield visually more appealing or read better on screen. Hard to say.

I personally like the clean shield and the interchangeable face plates that come with the regular version because if I were going to replicate a scene, it would be the scene where Bucky and Cap are beating down IM, as show in the first trailer. Like Motux said, I think it's quite demonstrable that this scene was used as the main reference when creating the regular version figure.
