Pretty sure Howard is referring to Batman since that's been shown at SDCC and still hasn't gotten an announcement. They said they have zero plans for Penguin and Catwoman right now anyways.

Probably just one of those things that happen when translating something from one language to another. Perhaps in Chinese what he said wasn't as vague as how it ended up in English? I don't know; just speculating

Who knows. It could have expired for all we know. The last interview Howard said they have no plans right now for Catwoman or Penguin.
