The Imaresqd1 act gave licensed enforcement teeth in it's fight against customs. Now people are talking about repealing the Imaresqd1 act and to them I say, not on my watch.

I don't think that would hold up in court. I know a thing or two about copyright infringement and it would be an extremely long and drawn out process to sue someone (an american citizen at that) for copyright infringing upon a corporation based out of japan by sculpting his own handmade items. Your sales would have to be massive and actually cutting into their profits for them to have a legitimate case. If you were hand painting a few heads and selling them on ebay they can't go after you just because yours is better than theirs and they can't afford your services. Look at all these knock off heads being cast on ebay of the various hot toys heads including the Joker dx01 head. I wonder if they went after those people?
 
It probably isn't copyright infringement in most cases. License infringement is far more likely. Different thing. Hot Toys doesn't seem to bother -- but they could pursue recasters and sculptors. It wouldn't be uncomplicated or cheap ... but they'd probably win.

Hot Toys doesn't seem to jealously pursue infringers ... but they could. Other companies aren't so friendly. Try infringing a Disney copyright or trademark sometime. They have teams of inhouse counsel whose sole purpose is to pursue people who do.

Sounds like a patent case. Not quite the same thing ... more of a technology-related breach rather than taking a likeness. Enterbay's a bigger fish anyway.

It doesn't really matter how far they're willing to go. They have legal recourse whether they're willing to pursue it or not.

I don't think the regular or the EX will sell out until there are in hand pics. Thats usually seem to be around when things start to sell out. Look at the MK1 2.0. ppl wanted that like crazy especially the ppl coming late into the game, yet it still isn't sold out yet
 
First off, I'd like to thank Tick-Tock, Intothevoid, and many other members here for your support.
I found it very interesting that there's other professional artist selling unlicensed Joker figures at a much higher price, and no one has said anything in terms of legality...
Hot toys does own the license of the Joker, and it's perfectly reasonable for them to do the best they can with the license they've paid for. And I think they did a great job. If they really did get any inspiration from my sculpts, I'm honored! I doubt that's the case tho.

For those of you who are familiar with me here, I was never comfortable with selling my stuff.(Maybe you've sent pms to me in the past without hearing back from me. Sorry).
I sold a very limited edition of a few of my sculpts before the massive release of the Wayne heads. I was in college at that time, and some extra cash was pretty darn great to help out between my tuition and rent, but that doesn't justify what I did, and it was wrong. It was stealing.
Commercializing sculpts of movie character/ celebrity without license is illegal for sure. In my case, I did not come up with the idea or the imagery of the Joker or Bruce Wayne, and I simply just copied their likenesses to the best of my ability from photographs.
I'm sorry for what I did in the past, and from now on I'd like to keep all my unlicensed stuff strictly personal, and I am working on some licensed sculpts too. I'll occasionally take one of a kind private commissions strictly on private basis.
Lastly, I will have pics of the DX11 head side by side with my attempt when it comes out. Hopefully, my attempt will be somewhat compatible with the DX11.

Thanks for posting Adam! Can't wait to see the new stuff you've been working on. You can't put a price (or a copyright) on artistic brilliance.
 
I'd say there will be since you can get the exclusive or the regular through Sideshow.

I'm actually pretty surprised myself...I ordered the first day it went up thinking that it would be gone....I've learned that this hobby is so unpredictable sometime

Why? I'm pretty sure the Hot Toys exclusives are pretty much open edition sizes these days (the exclusives with the extra doo-dads, not the con exclusives, that is). I don't think I've seen a HT exclusive sell out prior to release in recent memory?
