i sent them a picture of it. they know its defective. but like they said in the email "There is an acceptable range for minor imperfections on a hand crafted item and the emblem placement falls into this range"

so i guess they dont care.
 
My Captain America arrived today from SSC. Second batch, I presume, since I just ordered it on Monday. Between my bad experience with the HT Superman and all the quality control issues I've been reading about Cap, I was pretty nervous about opening him up. I was very relieved to find both my "A" and star are even and perfectly aligned. So it seems not all of the second batch is affected by these issues.

However there is something else wrong that puzzles and upsets me. While the figure itself looks great and was clearly new in the packaging, the accessory tray located inside the top cover had clearly been tampered with. The plastic tray was covered in scratches, and wasn't secured in the flaps as it should have been. The tape had also clearly been peeled away and reapplied. This didn't bother me too much, until I removed the shield to find it covered in scratches! This thing looks like someone played with it, damaged it, and put it back in the package. Also, for those who have recently opened this figure, shouldn't the shield have a sheet of protective plastic over it when you first open it? Mine was just rattling around inside the tray. I don't like to make assumptions, but if I didn't know any better, I would say SSC sold me a used figure. Or at least swapped out the accessory tray in mine and stuck me with a damaged shield. I am considering shooting them an email requesting a new shield, but the damn thing is so shiny, it's almost impossible to photograph the scratches. They've very noticeable in person though. What do you guys think I should do?

I received my Captain in perfect condition, except for the shield. Like yours, my shield has very visible scratches on one part of it. As if someone at the factory rubbed it the wrong way.

After a string of emails, along with a picture of the shield showing the scratch marks to SSC Customer Service, SSC is sending me a replacement shield. They shipped my replacement shield yesterday. I should be getting the new shield replacement end of this week.

So there should be no need to send back the whole figure or any of the accessories since I've learned SSC had been waiting for replacement parts from Hot Toys before they sent my replacement shield.

I recommend you contact SSC for a replacement.
 
Just now reading thru a little bit of this thread. Guess my chances of getting a replacement from SS because of the crooked star on mine are blown.
 
Does Sideshow really resell returned figures? Because aside from my shield covered in scratches, the dinged up packaging and visibly peeled/reapplied tape everywhere is hard to ignore.
