the only solution to this would be to refund the buyers money back. he would have to cover the return shipping. ask him to ship the items back to you the same way you shipped to him. shipping fees and insurance fees. sometimes the buyers will not want to go through the trouble of doing so.

Downside is I have a feeling he would remove the "missing" pieces and break the staff in 4 places before sending it back.

I am going true a dilema right now with the guy i bought MEDICOM DARTH MAUL.

I bought him like 5 months ago (paid) and I still havent got him.
He wont return my emails, hes phone is out of servise etc...

I contacted paypal and visa and they cant do a thing for me because it has being too long :(

I just filled a complaint to IC3 (federal consumer internet cam investigation)
so hoppefully i will get results but I think I will never see the money or the figure ever from him :(

the name of hes store is : COLLECTORSUNIVERS.

have you guys heard about him before?

it's your word against his. unfortunately you may get a negative but i think pp would side with you because you have proof he received it.

That would make no difference in this case, because the guy is claiming that the items were either not as described in the auction or that they were damaged in shipping.

Personally I wouldn't be confrontational about it. I'd just say that everything was intact and complete when it shipped and he should check the packaging again as he's obviously missing something.

I agree. All of you people advising Pitu to tell the guy to go screw himself are not really giving him very good advice. It's always possible that it's just a misunderstanding, first of all. And even if the guy is trying to scam him, you have to remain calm and professional or he can use your offensive emails against you.
 
Seeing as you paid for insurance you may as well start those proceedings. Then get him to post the items back to you. Tell him you'll refund him when you get the articles back and the insurance is paid out. Then when you get the money and the figure back, disappear into the sunset. Just pulling your leg. See if you get your money and the figure, then decide your next course of action, depending on what the insurance pays you, you may have to take out some coinage for ebay/paypal fees listings and other sundry expenditures. I just went through an ebay headache where the buyer was clearly trying to scam me.. All the while throwing out paypal claim threats.. I stood my ground and the weasel eventually crawled back into his hole..

No more selling for me after that hassle..
 
Unfortunately, it is your word against his... and PayPal almost always sides with the seller. I have been selling stuff for 5 years on ebay, and this has only happened to me 3 times. Each time I didn't even have a choice in the matter. PayPal refunded the money each time without my authorization. It's getting to the point where I really despise using it, but the alternative of waiting for money orders is always a mess, to say nothing of all the international orders I would loose. It really doesn't matter what kind of return policy you state, PayPal's going to do what they see fit.

I would seriously try talking to the guy again. Try even calling him. His phone number should be on the PayPal receipt. If you try to talk it out, and stress that you really know the merchandise and stress how you always triple check your orders, he may back down. And who knows, he may have made a mistake. Above all KEEP YOUR CALM. If you get into it with this guy, it will only look bad on you. Again, experience on this one.

If that doesn't work out, be prepared to lose on this one. It sucks and I really feel for you; I've been their myself.
 
Unless the box is clearly and severely damaged through the fault of the USPS or whoever you shipped it through then they will never cover a claim. The only way to really ever get an insurance claim paid is if it goes missing. Even then it is like pulling teeth.

So I would have to disagree with those telling you to do that. Unless you have some sort of irrefutable proof it was the carriers fault then ourya ewdscra.

Just empty your PayPal account, send him correspondence and in a professional manner state your position, then go about your life and don't give it another thought.

End of story.....
