All renewed with Fox recently. FF and Daredevil could have gone back to Marvel Studios this year but they renewed Fox's deals.
Its more complicated than that, two studios means shared merchandising profits, shared advertising profits and costs, that is where the red tape gets thick because the studios want all the money. Remember the Watchmen fiasco? Two studios fighting over cash nearly had it delayed in premiering, I can only imagine with something as cash cow as Spider-Man and/or the Avengers. What I mean by the rule of Red Sonja is that Arnold was in that film obviously as Conan. The thing is they didn't have rights to Conan so he was called Kalidor but everyone knew who he was supposed to be. Same could happen where you get a Wolverine look-a-like named Patch (a Wolvie alias) or in Captain America, a Canadian solider could walk past with a familiar haircut for example and they'd get away with it.
Really? Do you know anything about the X-Men, F4 & Daredevil licenses? (when they go back to Marvel Studios)

I wonder still, if the Avengers is successful, would they consider making a cross studio deal for a Spiderman and the Avengers sort of flick. I wouldn't put it past them.
