I'm sorry, but did this Adam character pay WB for the license and rights to use and sell the likeness of the Joker character?

Did he pay royalties to Heath Ledger's estate to use and sell the likeness of the actor's face?

Is anyone that is actually connected to the creation of this beloved character, or this specific, beloved incarnation of the character, receiving any sort of compensation for their hard work, which apparently has been used to generate income for this presumably unlicensed artist?

Because I know Hot Toys sure as hell did pay for it.

Maybe you should think twice before you throw around words like "stealing," and consider who is doing what, exactly.

What are you, the FBI? What difference does it make who paid what fees for which license? The subject of discussion is an artist's work -- and whose work came first and, most importantly, was of superior quality. This isn't a legal forum, none of us are debating intellectual property rights. Though it's a bit ironic that a Hong Kong firm's IP rights are being defended, as if China has been a paragon of this.

I'm not the first to speculate about this and I certainly won't be the last. So long as Adams work is superior to Hot Toys', and so long as he continues to be the torch bearer for Batman related sculpts, this speculation will continue.

All of this talk of "stealing" brings up an interesting point; if HT wanted to, could they recast Adam's sculpt, get it approved by WB, and produce it with no legal repercussions? If that was the case, maybe you shouldn't be so quick to accuse them of stealing after all, at least they're producing their own work. :dunno

Stealing is the wrong term. I think I meant that Hot Toys was heavily influenced and inspired by Adam's artistic achievements. There were many scenes and expressions of the Joker they might have chosen. They chose the one Adam created first, and that received a very positive response on these boards (and, it should be noted, quickly sold out).

Just because HT choose one of the looks that may be included in Adam's army of Joker expressions, they're suddenly "heavily influenced" and "inspired" by him. My personal view is that this whole thing is a big load of hooey, but the fact of the matter is that we'll never know what the case is.
 
While true that HT could've very well been inspired by Adam's work, we don't know that for a fact like we do about Kato being behind the clothing. The interrogation scene is one of the biggest scenes of the movie and one that HT had yet to make a figure based upon. Not to mention the fact that ppl on their FB page have been asking for a laughing sculpt for quite some time. Also, the image that the particular laugh/scene is sculpted from is readily available and easy to find and one of the first images of the Joker laughing from the movie before the movie was out of memory serves me right. It's on one of the months for the TDK calendar for Pete's sake. Even MRM sculpted his laughing sculpt based on that image. So how can anyone rightfully say that HT was trying to be like Adam? Just b/c he sculpted that particular face first? Come on. How many ppl sculpted T2 Arnold before HT did? Lots of ppl. So does that mean HT was copying or "inspired" by all those other custom artist as well?

Noone can prove anything about what influenced HT's direction with Joker 2.0.

All I know is that it looks eerily similar to this:

I'm sure all the Hot Toys fans clamoring for Adams sculpts and demanding that they hire him didn't factor into their decision at all. That said, the above image gives me pause.

I'm by no means a HT fanboy. If anything I'm a sideshow one :lol but if they used the same image to sculpt it from they should come out looking pretty much the same especially if they really took they're time on it to get it as close as possible. HT may not get it 99% right every time but just b/c this came out looking good we can't say that HT did good for once? We have to say that they got it from Adam just b/c Adam did it first?

If it were just the headsculpt alone I would totally agree with you. But the fact that they went and hired the tailor for the outfit featured in that pic, and also replicated the table and chair set, AND then chose the exact same reference image for the laughing head.

I don't know, somehow I think the factors are all connected :lol

But I am clearly biased seeing as it is my pic, so be that as it may.

Either way i'm delighted they went the direction they did - good for everyone and especially those that desperately wanted a laughing head or Kato's clothing.

But if they're going for the interrogation scene it would make sense to include the appropriate Dio for the scene as well since it is DX which are known to typically come with something extra (ship wheel, weathervane, BL's ETD dio, Indy's Dio). Also, don't see how Kato's clothing counts in trying to replicate customs vs trying to have the best outfit there can be for their latest Joker. I would agree with it if Kato wasn't brought on board it then they revealed the 2.0 and it looked like they tried to replicate it, then I'd be like yea they saw what Kato did and tried their own hand at it. God forbid if some had made some fabric shoes with real laces :lol Just trying to say give credit where credit is due. We do it for the customizers :dunno HT did good overal this time, what's wrong with that?

At the end I don't care...I'm getting the best mass produced TDK Joker until the 3.0 so I'm happy :lol

That said, Adam made some good cash on that head before now. And Kato made a killing on the clothing on the side before the HT announcement.

They did great, no denying that :clap

Me thinking they were inspired by some of the top custom artists in the hobby doesn't change that.

How'd he get burned?

He made his laughing head and sold 3 copies, and decided not to sell any more. That was 2 yrs before DX11 was even shown. He's way past the laughing head now

And until we see the production versions of clothing there's no telling how closely it will match up to Kato's handmade clothing's quality.

I don't think he really got burned, unless you like the idea of waking up one day and seeing something that looks exactly like what you did done by someone else. But in this hobby, that happens alot. We're all after the same characters.

I'm sure he's fine with it and has moved on. I have. Besides, I said he got plenty of money for the 3 heads to make it worth his while. Weren't they $800 a pop?

Imitation is the sincerest form of flattery, I think he's doing just fine. :lol

And they were a bit less than that, but not by much
