Ok guys I'm a little worried. My LCS STILL has not gotten their shipment of DX Batmans in yet. I'm getting a little worried that they wont. I've called the owner several times and he has told me that he will call his distributor, and see what's going on then he will email me back. Still haven't gotten an email from them. There for I do not know what I should do. I have already paid a deposit on one, and do not know if I will get one.
My question is what should I do? Should I just cancel and get my deposit back, and buy it somewhere else? Or should I just keep waiting. With the way the price of the figure is sky rocketing as the days go by I don't want to wait too long to find out they wont be getting it. But at the same time I'll be paying a little more now for the figure if I cancel and buy it some where else.

Sounds like your LCS is being a bit flaky (possibly because the distributor themselves are being flaky). If I were you, I'd get the DX02 elsewhere, IF you can find one for a reasonable price.
Then, if the LCS finally gets theirs in, you should make sure that they call you first and give you right to first refusal (since you tried to be a loyal customer but they couldn't seem to guarantee anything). If they're indeed a local business, they should want to do this, to make sure you remain a local customer (especially with customers turning more and more to on-line sources for cheaper comics and collectibles).
That way, if the LCS doesn't get the DX02, you still have one - it'll be a bit more expensive than the LCS price, but you might want to get it now, rather than find out in a month that the LCS isn't going to get it after all, when the price is going to be even higher.
And if the LCS does get the DX02? You'll have the option to purchase it at a lower price - so either you'll have two DX02s, or you'll be in a position to sell it unopened, for perhaps a little bit of a profit.
Worth thinking about, at least.
EDIT: If you do do this, don't tell the LCS that you plan to get it elsewhere anyway. Just ask for your deposit back, say you're thinking of looking around for it elsewhere, and make sure they call you IF they do get it in, in case you haven't managed to find it from somewhere else.
