Yeah and that's where these most recent tweets are a bit worrying.
We know that Randy could be in touch with Mark / Drake but not Al Apone. So when asked:
Tweet: Any chance for a Pvt. Drake and/or Sgt. Apone for the Aliens series?
The reply is:
Neca: only if they allow their likeness to be used in a reasonable agreement that works for both parties
can't comment on any ongoing negotiations
Now we know the deal with Apone so forget him, Randy is talking about Drake here
So why would Randy say this unless they were struggling with Mark to come to an agreement? Randy basically just told all Neca's twitter follows that: Drake will only happen if we can come to an agreement with the Actor. No one would post that if everything was going smoothly with their current negotiations or if they hadn't even asked the Actor yet...
In my mind they are clearly having problems negotiating with the Actor. Hopefully ones that can be resolved, but that is why I'm pointing this out. It might not be looking soo good...
That or I'm reading into this whole thing way too much...
I could see that side too, maybe we can tell Jenette to tell him to allow his likeness since he will listen to Vas - lol. I've looked on Mark's twitter page recently and I don't think he's posted anything in years so maybe things are just going slow if Neca is pursuing him and he will allow at some point. He seems like a good guy from interviews I've seen with him.

I consider myself a hardcore fan, but even I wasn't interested in the space suit Lamber/Kane/Dallas. Would much rather have them as the normal crew, and Parker, Brett and Ash, gotta have an Ash....
yeah but then to remove in and out would probably have presented a problem for the size/scale. Cool, but not a necessity in my book.

You're definitely overthinking the tweet. There's only so many ways Randy can say "Maybe but not yet" in a way that doesn't spoil any forthcoming surprise(s) while keeping the fans salivating for more. Remember how just a month or two prior to the Newt/Vasquez reveal this year Randy was not only claiming that they didn't have likeness rights for Vasquez but also suggesting that Newt was not a likely candidate to ever see action figure form? He may not have been lying in his responses, but he was absolutely withholding the progress that had been made with each of those figures at the time. As much as Randy gets asked about the possibility of Drake and Apone, you can bet he's going to be ambiguous in his responses regarding either character until some occasion (like Toy Fair or Alien Day or simply a slow period between series) provides an appropriate reason to reveal the next 'most requested' figure. Until then...
Maybe we fans need to start being a bit more vocal about our interest in getting figures of these 3 characters? Without a doubt Randy knows that fans want Drake and Apone so NECA WILL make those Marines if they can. But I wonder whether NECA might doubt the profitability of Crowe, Wierzbowski, and Dietrich, seeing as how these less popular Marines are rarely (if ever) requested. It'd be awesome if we could get 100% of the Sub Level 3 squad, but (actor likeness rights allowing of course) I think it's up to the fans to give NECA the 'green light' to go for it by expressing our interest in getting ALL of the Marines as opposed to just the 2 remaining fan favorites (Drake and Apone).

With Frost getting made Dietrich took a jump up the priority list for me given her role in his demise. It'd be a good scene to set up on the shelf. Plus she's unique in her own way being a female marine in the armour and helmet.
Drake, Apone, Dietrich, Gorman, Burke, Wierzbowski & Crowe, Ferro & Spunkmeyer would probably be my priority ranking now (if I don't count variants of existing castmember figures)

I am guessing one of those would be the Alien 3 creature pack which I am excited to see how they pack out. I am hoping we at least get a Queen Facehugger and a Bambi burster. Other than that I am open to being surprised.
Another pack would have to include the sentry gun or guns along with maybe a chest bursted animal maybe.

I didn't even think of it that way but you are right. If we are going to get the next biggest death from that squad then she would be the next in line. Plus, she is also another female and unique also in that she is a medic, a role which is not usually given the spotlight or an action figure. Added to that, getting the likeness rights might not be such a pain in the arse like a bigger name might prove to be.

Its been asked enough on twitter for it to be almost a giveth to come out in at least one of the packs at this stage, or with a figure that would need help selling.
