I get what you are saying. I suppose someone could start up a social group and have it be invite only (only those people who want to take legal action or have stuff or money owed to them) could join. I would run it by Darklord Dave first though before one was started...just to make sure he is ok with that.

So that you can continue to sweep it under the rug so it's no longer visible on a public forum where all can see the crimes he's committed and the consequences of his actions and to avoid the embarrassment it would bring to this site and the mods who defended him. Great idea.

I had to bump this thread.... I went to GA and picked this up this past weekend from James. And WOW... the pics don't do it justice, this mask is a beauty in person. James really knocked it out of the park, as usual. I needed a good positive emotional boost, so this was very well timed. I'm honored to finally have a JC mask of my very own.

The eyecuts are sick as Hell, the hairline is perfect, the paint is has that vintage H1 vibe, the hair feels like old DP hair.... it's really an amazing effort on his part, a very accurate representation of the H1 mask. I couldn't be happier. I'll try to get some pics soon to post up, for now I just keep staring at it and am just stunned that it is here and it's MINE!

I defended Josh , I loved his work and posted something positive almost everytime he shown a new figure. Now it's ended up like this !.
It's incredible that he had met so many forum members and threw partys inviting them. That there as well as how honest he seemed to be being about everything I think is what made me belive he truly didn't mean for this to happen and was going to fix it but now it's just beyond a joke.

I don't understand how people sending money to him can't get there stuff shipped back. Just walk or drive to the post office. :dunno

Now he's buying expensive masks and apparently new games whilst all of our stuff is still there , half unfinished , unshipped and all our money is gone. Unbelivable.

I have no problems with any other members but from now on I'll only be buying things from people who I know I can trust 100% or who make a run of something , finish it and then sell it. It's easier for everyone that way and should be a rule here imo.
Paying for something in a group and then waiting for it to be made and shipped for months always seems to end in trouble or someone complaining.

All these nightmare commision situations as well as all the Neca fan boys and obsessive complainers is what have made this forum a crappier place imo. I'm not the only one who thinks it.
I wish figures still had huge heads and all there clothes were inaccurate and bodies out of proportion. It was a better place then. :lol

I personally wouldn't take this any futher but to all of those who are I don't blame you.
 
So Jen, do we know if the timeframe of Carl sending the items out is still on track? I know he stepped up to the plate to help out and that it is a large undertaking but, he has had said items for quite a while now and, as far as I know, still no one has any of there stuff. My faith is in YOU and carl but, especially with these items, faith runs thin. Having been waiting since 2007 I was hoping turnaround to be quicker. It certainly doesn't help to only have moved our items from one house to another if neither of them are ours.
 
Jen posted this back in December.

Just heard back from Carl. He has been traveling a lot and is hoping to get started in shipping things out in January. With the holidays upon us, it is just not possible for him to start shipping before then.

Here is an excerpt of the email he sent me:

I'll start shipping stuff out the first 2 weeks of January. Before then just wouldn't be realistic, with Christmas and all.

Here is the plan: The first week of January I will send you a list of all I have to be shipped, broken down by person and what each would owe for shipping. It will also include Paypal payment instructions to cover shipping. Once people start sending in payments, I will ship their stuff out within 1 week of receiving the payment.


So if all goes as planned - most of you should be getting notification from either Carl or myself shortly after the New Year.

I considered Josh a friend as well and even defended him. Even though he had my items SS Indy and Toy Biz Gimli forever. Hell, I even came up with a way for him to send stuff to Les and he'd finish it.

However, after seeing him play multiple new games on xbox (which is several games at $50-$60) and the post about him buying a $500 mask I'm done beyond done. I've felt this way for a long while. The guy has ripped me off and others and its time that things come to an end by people taking legal action if they can. I'm leaning that way myself sadly.

I've seen several excuses in here for Josh still and I'm sorry they just don't fly. You man up and take care of what you need to take care of and that is the right thing to do. Like Mesa when Josh got picked for the spook chat I was a bit annoyed considering what he's done and I almost sent a PM to UT that he shouldn't pick Josh.

In the end Josh has made me far far less likely to ever get custom work done because I'm not sure I'm willing to trust getting my stuff back.

Thats an incredible shame, there are many custom guys on this forum that are so talented and are 100% genuine.

Josh was really friendly and would reply back to nearly all messages he recieved on his old custom thread. I'd think he was one of if not the most polite and talkative custom guys here. I think that's what would make people so wary from now on. If I had to guess who was going to do something like this 3 years ago I'd have never belived it was going to be DA.
It's crazy and a shame how it's all turned out like this.
 
He was too friendly. Priced his work way too low, and never turned away a commission. It's a shame that it turned out like this, but I don't think it was crazy. I don't see any other way it could have. There was no way he could have done everything he tried to in the time he had, and as the kind of artist he was. He was too emotionally invested in the work, and not enough of a laborer. Between the adulation he received and what appeared to be a genuine desire to help out those who wanted the same things he did from their figures, he had no grasp of what real limits he had to observe if he was going to succeed.

I don't think he's the bastard he's being painted as, but the end result is no different than if he was. He's reneged on his responsibilities, and that deserves the same condemnation as if he had purposefully robbed us. It's pretty goddamned offensive that he can't be bothered to act like that's the case just because it wasn't what he was doing, and he has guaranteed that he will pay far more for it than he ever would have owed if he had honestly taken his lumps.

But one good thing came from this. Everyone who said he was scum all along got to say they were right. That has to count for something, right?

Do76, I recall that post of Jen's, but I'm more concerned if the timeframe is still valid. Halfway thru the first week and I haven't seen anyone post that they were contacted or that their items are on the way. If he's moving in January as was also posted, then time is running short.
 
I'm sure it's in his interest to get it done before he moves, otherwise, he has all of that stuff to drag along with im. He is definitely cutting it close because moving tends to bring lots of unexpected BS, and shipping tons of stuff all over the country is a major chore. I guess we'll find out soon enough.
 
Fact is people who try to run businesses with the best of intentions but little discipline go out of business all the time taking people's money with them. It is not looked at as a scam by the government. The worst any action you guys could bring against him would be to force him to file bankruptcy at which point you wouldn't get your money back anyway and your motives are exposed as merely revenge, rather this noble idea of justice and "teaching him life lessons".

Josh did a crappy thing. I still don't believe he was willfully dishonest (like Melvin Pelayo was.. but most of you guys are too recent to even remember him). He was naive. He is kind of trying to play the victim now, which is really annoying. But the constant barrage of "told you so" and belittling of the people who called him "friend" had me a wee bit on the flame yesterday.

And with regard to Deckard's assumption and frankly quite shallow definition of friendship:

You've hung out with him? Spoken to him in person on the telephone? You know his wife's name? What his favorite color is?

I have spoken to him. I know his wife's name. I pretty sure I can guess with accuracy what his favorite color is. I also now that one of the ones who is currently on the bandwagon of punishment benefitted from ride's in his car and was given permission to stay at his place FREE of CHARGE. This is what friend's do.

The best of you guys who were scammed are justifiably angry and should do whatever you feel is an appropriate recourse. The worst of you guys who were scammed (or weren't scammed at all by him) are petty trolls looking to stoke a flame and get folks riled up while you sit back and laugh (which is quite reprehensible in itself).

It has nothing to do with defending anyone. No one has defended him in recent memory that I can find. Don't mistake people calling others out for their petty and shallow comments as defending Josh.

and Yeah Devil, Josh made 3 big mistakes.

1) Charging too little for his work.
2) Taking on more work than he could handle.
3) Spending the money on work he had not completed.

As I said, there is nothing criminal in what he did. I see people like him everyday in the business I work in (bankruptcy). It wasn't very ethical what he did. He was a coward in the end by running away and letting someone else do his work for him. But here it is. I guess we could say that the road to Hell is paved with good intentions.

My biggest gripe with Josh is the simple fact that he gave up! He didn't even bother trying to rectify things or finish even half the things he started. He could learn a huge lesson from Les, who I might say was even worse off than Josh in terms of personal issues, but still to this day tries to clear his backlog.

I think you summed up my feelings on the situation brilliantly Pix.

I too know Josh from interactions here and have been to his home last October; so I do consider him a friend. But sometimes friendship means accepting when your friends have made really bad decisions.

There is no real excuse for what has happened, but at the same time there is no real solution either at this point. In the end everyone has to just do what the feel is best for them. I don't plan on getting my Myers figure, but I can live with that.
 
Where does Carl live--in Florida too? I'm a little over two hours from Josh and I wish I had known about Carl undertaking this sooner. I would have had no problem driving up to Josh's and helping out with the load. I do ebay sales almost every week, so going to post for me is a 2-3 times a week deal. So, Carl, if you need some help here in Tampa--let me know. And great post Pix.
 
I was thinking Carl did not live in Fla, but in an adjoining state... part of the reason it took a bit for him to get the items in the first place.

EDIT checked an earlier post, he's in Atlanta.

No - obviously we are not sweeping it under the rug or I would be deleting any posts that are not directly related to us getting our stuff from CARL not Josh.

People can talk about taking legal action here - I was only SUGGESTING that if someone wanted to have it all in one place - that starting a social group was AN OPTION - so all the information could be EASIER to find.

And I really don't know what the hell your beef is kl241. You want a medal because from the get-go you wanted to throw Josh to wolves? Good for you. Do you REALLY think that if we all had the same attitude as you that YOU would have ever gotten your refund? I really, really doubt that would have EVER happened. So what's your problem? Aside from a handful who are still friendly with him - I see quite a few people that wanted to give someone the benefit of the doubt and sadly realized that Josh's word didn't mean a hole hell of a lot. So we misplaced our trust in someone. Happens to the best of us.....I don't see why you have to keep saying this stuff over and over and over. You are becoming a broken record - no different than the broken record of endless promises we kept hearing from Josh.

I have not heard back from Carl since the last update I left. I will email him again and see if things are still on track.
