Is the battery already in the helmet when you get the figure? I'm thinking about tracking one of these down on eBay and was curious.

when its factory sealed ,its not inside the helmet.and its a pain in the behind to open the screw for the battery case.mine is too tight

I've got one of these brand new for sale if anyone is interested. I ordered one back when i was considering starting a Marvel collection, but am sticking to Star Wars and DC. It's tempting to keep since all of these photos look so good
