So this is still going on and I haven't heard anything from Ebay yet. Hopefully they are just researching the facts to lay the hammer down on this guy. I am still getting abusive emails and the unpaid item strike still stands for some reason.

Will keep you guys updated. There is no way I will remove that negative feedback, especially not now after the way this "man" has behaved. :lecture

About 3 years ago I bought a MISB vintage item (Davy Crockett figure) from a guy, when it arrived it was clearly opened and the foot had be snapped off and crudely glued back together. He tried to claim it was damaged in shipping (yeah right) so I opened a paypal dispute (items not as described) and got back the full price of the item. He was pissed, but not my fault he didn't take care of his responsibilities.

I am seriously contemplating opening up a Paypal dispute. If not for the simple fact that he claims I never paid. I am sure he would respond to that paypal email with some type of "proof". The guy is a serious looney. I am waiting to see what ebay says. If they don't do something about this abuse then I will have no choice but to go through paypal. They always side with the buyer. And if not through them then my credit card company will help.

Anyways, how long is the window open for a paypal dispute?

It's really ridiculous what this seller is doing. I mean, I give him a negative, which he deserved, and now he wants to make thousands off of me by suing me? :rotfl

I hope ebay does something about this guy. Everything he has accused me of, he has done himself. He is trying to strong-arm or manipulate me into removing the negative comment. He is threatening me and harassing me, and he also submitted a false unpaid item strike against me. What's the deal with this guy?:lol

But even if he did, what kind of a case would he have? None I think. There is nothing here that he has lost. I never started a paypal dispute or said anything inflammatory that would hurt his business. Only a truthful negative feedback. :huh

He does not have cause. You left a feedback that is allowed by the system. You have not attacked or slandered him. You requested help which he refused so you left the feedback that reflected your exp with this seller which is permitted by eBay.

He's hoping you will get scared and remove the feedback. He cannot win any type of lawsuit here.

it's obvious this guy is blowing smoke. he doesn't seem to have a grasp of english either, which makes his communication relay a problem. if someone could sue for something as little as negative feedback, can you imagine how overburdened our court system would be. :horror

Not only that but I am pretty sure that you can't sue in small claims court across states. He would physically have to come down here and file. Which is completely unrealistic and then I would have to be subpoenaed. The guy is just a hot head who wants to threaten and coerce me into doing what he wants. It isn't going to happen. The worst anyone could do, even if a feedback wasn't legit, is have ebay remove the feedback. This suing business is very stupid. :lol

It's apparent he has never sued anyone before because he doesn't even know how it works. You can only gain what you have lost. He hasn't lost any business as a result of my negative... especially not thousands of dollars! :lol

Just out of curiosity, do you think the items were damaged because of transit (like a severly crushed box) or were they probably always damaged? I don't think it matters much, as a seller you can still loose a complaint even if the person doesn't want insurance and the item gets damaged in transit.

And the free shipping thing on his part is hilarious, everyone knows that offering deals and incentives means you **typically** end-up with a higher end price. Its just a simple trick to get people to pay more money and think they're getting a deal :lol

With paypal you have 45 days to file a complaint... with credit cards I think its more like 90. I'd file for at least a partial refund, when something is damaged it means you got less than what you paid for.
 
Oh and on a related note, I assume you are saving all of his correspondences... you could probably eventually sue him for harassment :lol

This guy is just not very smart. I think the items were damaged when he shipped them. The shipping boxed looked fine. I am still waiting for eaby to do something. If they take action against him then I will consider my work done, if not then I must proceed further.

The price he sold these for was including shipping. Everyone knows that's how the free shipping offers work. :lol My mistake was buying from this guy. You can learn a whole lot by looking at their past negative feedbacks. What really gets me is how immature this man is behaving. Is this representative of our population as a whole?

I know if I don't get that unpaid item strike removed that I will file a claim. It's just that simple. If I never paid according to him in his delusional world then I will make it a reality.

By the way I save everything when it comes to things like this. That's the only way you can win disputes. The cold hard evidence speaks the truth in the end. Plus, everything he has written me I have sent to ebay for their verification. :)
