Never had this issue but I think if you returned the item the onus would be on the seller to take the case up with USPS. As rayeknor said, the seller is responsible for the item arriving to you in the condition it was sold in. I would honestly go that route. Worst case scenario is you're out the return shipping but the seller is supposed to be responsible for that too, better than tracking down a box and a new stand.

You should have not open a claim with the USPS, but instead filed it with ebay or paypal.
I've been on ebay since it started and have a lot of experience with selling, as well as buying.
It's seller's responsibility to insure the item, regardless of if the buyer wants insurance or not. If he did not insure it, then he is an idiot. It is also the shipper's responsibility to pursue any claims with the shipping company since he/she is the one who has the shipping receipt, to prove that it was insured.
And again, if it was not insured, it is the seller's problem, not buyer's.
If you open a case with ebay, for item received damaged, you will get your money back, including shipping, AND a return label from the seller.

I always tell sellers - INSURE YOUR SHIPMENT! Regardless of if the buyer "..opted out of it.." or not. Because buyers, most of the time, want to save money, and will say anything to cut their cost. They will "..take full responsibility. blah blah blah..", but if something goes wrong, they will file a claim and ALWAYS WIN.

If I were you, I'd open an ebay/paypal claim, get your money ( which you 1000000% will ), and let the seller chase the USPS/UPS/Whoever for his refund. And instead of hunting for boxes, bases, pieces - Just get your refund and buy another one.
 
Okay, Anakin finally arrived. Pictures incoming, but why the hell did they put the switch for the light up base UNDERNEATH the base, not on the sides/back? Also, I may have just missed it but does it come with a regular stand? I see the crotch-grabber, but I didn't seem to see anything for it to click into.
Also also, they need to find a better place for the light-up sabre switch. Uncuffing then recuffing his gauntlet is going to be annoying.

Still, solid figure.

Yeah, he may be a nice seller. But as a seller with over 1000 positive feedback and ZERO negative, Its his fault it arrived that way.

I never ship anything unless double boxed. If he sent that to you in just the brown shipper.....well thats not enough. HT brown shippers have no structural support , and we are lucky this does not happen more often.

Open the PayPal case and work with him on getting satisfaction from UPS. If you both attack UPS you are more likely to see a refund......unless its totally uninsured.....which in that case its his fault...entirely.

You can always work something out with him, but if he is gonna be a hard ass, hes gonna find out Paypal and Ebay will be 100% on your side....and he will lose every cent.

To be fair, you can open ebay case and most likely win, sellers are legally responsible for an item until arrival. Tho since it was smashed by usps (not surprised, I got some stories) it would be kind of a **** move, but understandable.

This is mainly why I buy figures etc. from stores, and ebay only for special items hard to get elsewhere.

Yea I'm regretting just not doing that first, but I already opened a case with USPS. Is it too late now to open a case with Ebay too?

Thanks for the tips and advice! I was thinking to just see what happens with the USPS case and if there's nothing in 2 weeks then I'll open an Ebay case. I think this should be good because I have 30 days to open a case with Ebay right?

Anyhoo, it's amazing how good you think photos look when you take them, only to realize they completely suck when you upload them. These are the least sucky ones...

I have had Sith Ani in hooded pose more than 4 months already, received from SS in August...no sign of staining or whatsoever....

Well, as a seller, I would try to refund the amount of the sale I thought was in the box.

Boxes for hard to find figure go for about 25-45 dollars on ebay. So offering a partial refund for an amount you agree on would be a possible solution.

So how much of the total prices does the box make up? 10% ? 15%?

Well this as most other figures look noticeably better in hand then the very majority of photos
 
I'm in the exact same situation. Australia post tracking service doesn't provide any info beside origin and destination. French post tracking only displays "drop/collect" at origin point on the 17th. I can only assume they are overwhelmed with traffic during that pre-Xmas week.
