Andy usually plays fantastic monsters. He's the Lon Chaney of the CGI era.

But, I can't think of a CGI character he could be... unless there's another villain.
Is it possible they would recast Abomination?

Tim Roth totally doesn't need recasting. But if they wanted to do him as the Leader (who I think was miscast), or Bi-Beast, or Wendigo, or Modok, or hell, apes for the Red Ghost, then that's all fine with me.

Isn't Wendingo a Wolverine enemy?
Yes.
Since Fox can't use the Hulk for their iconic tussle I'd always hoped they'd use the Wendigo against Jackmans Wolverine.
That could be an amazing and brutal fight on the big screen (also a way to introduce Alpha Flight in the great white north in canuckle land)

Yeah, the Punisher first appeared in The Amazing Spider-Man but he's not a Sony film character.

Wolverine first appeared in The Incredible Hulk but isn't an MCU Hulk villain.

And so on.

Which really makes me wonder how exactly the character breakdowns work out in the contracts. I mean Rhino has fought both the Hulk and Spider-man, but he ended up with Spider-man. Just about every hero has been an Avenger by this point. And I think everyone has fought Dr. Doom at least once. So if it was just if a character interacted within a property, they could almost claim rights to that character. I'd say its clearly not that case, but then again, somehow both X-men and Avengers got the rights to Quicksilver and the Scarlett Witch. So things aren't as cut and dry or as fluid as they could be.

I just wish Hugh Jackman would sit down with the heads of Fox, Sony, and Marvel and say: Here's how it goes. We split the costs evenly. We reap the box office evenly. If two studios are involved in a project, its funded 50/50 and they earn 50/50. If all three are involved, then its 1/3 all around. Maybe a clause with freebie cameos if a freebie cameo is returned? Otherwise, totally split costs and rewards across the board. Everyone would win. They get to use the characters they want, they spend less than they would have, still earn more than what they needed to be successful, and the fans get to see what they want. Why is that so difficult!?!? :lol

My main theory about Wanda and Pietro was that they did first appear in X-Men comics BUT they have been a part of Avengers books way WAY more and way longer than X-Men which is why we can both use those characters.

The same could be said for Wolverine then. He was a Hulk villain first so Marvel should have been able to use him in that way right? Even though he's been an X-man Way more and way longer. So I still really don't get the idea behind the split on Wanda and Pietro as the same excuse could be used on so many other characters.

I don't know how they do every single villain, etc. But from memory the X-men contract it stated that characters considered X-men affiliated per the Marvel handbook at the time of the contract. They also had a court case with Marvel in the late 90s, over trying to develop something with Havok and the courts sided with Fox stating that even though Havok wasn't a member under the agreement, his being a direct relative to a core character in the comics made him a Fox character. This is probably why a lot of minor characters coulo be either/or. The twins have been Avengers for decades, but they still have that same familial link cited in the past case.

Its probably a really tangled web now. I doubt they expected things to explode like they have. So its probably tough figuring out who some of the villains belong to who because they may or may not have any direct ties to one franchise. The only thing I know for sure is that they've all managed to somehow share the awesome character known as Stan Lee :lol Now why can't they all get along with more characters?

Yeah, I'm sure that's how that works. :lol

Not!

The Twins first appeared in Avengers... yet both Marvel and Fox have the rights.
The Kingpin is a Spider-Man villain... yet he is appearing in the Daredevil show.
Kang first appeared in Fantastic Four... but Marvel can use him.

I'd say Marvel has the rights to all characters that aren't primary Spidey, FF, or X-Men characters.

And at the end of the day... no one owns copyright to the name 'Wendigo'. It's a Cryptozoological creature.

:dunno

Yes, we already knew you're theory of first appearance stank, *Khev already showed that in his post, but your examples further show first appearance = jack. :lol

Some characters require a 'special deal' between Marvel and Fox, I would say the contracts specify which characters they can use, I'd love to see the lists
