Received yesterday my Mark IV finally, and should I say that is GORGEUS!!... however the left air brake flap (hinges) was boken when I tried to open it! .

Be very careful and patient with the air brake mechanism.. is very hard to pull, and the hinges are very thin ultra fragile...

There is a difference, because Sideshow is a U.S.-based company with a close relationship with this board that the Administrator would not want to jeopardize. Hot Toys is based in Asia, has tip-toed the line between violating license agreements themselves in the past ("poseable models," likenesses masked with paint jobs, giving nude bodies and military guys recognizable heads to go on other figures, etc.), and probably would care much less if someone here was doing this sort of thing.

But more importantly, you have to consider the thing being re-casted. A weapon, Predator mask, or stand, for instance, seem like pretty tame things that no company is gonna get all worked up over (though you never know). Particularly when they only sell those things as accessories. If you re-cast an entire bust, statue, or figure, that's a pretty significant difference.

Having said all this, I've never bought a re-cast that I'm aware of and have no intention of doing so (well, not including Transformers ). But I don't think this is a double standard issue since the types of recasts discussed are pretty fundamentally different.
